Delay in the new Civil Code
Doležal, Tomáš ; Štenglová, Ivanka (advisor) ; Patěk, Daniel (referee)
The thesis which is called "Delay in the new Civil Code" analyses the general legal regulation of delay and its consequences under the current civil code and related European and Czech legislation. The thesis explains the system of the current regulation, explains the nature and meaning of delay, defines the term "delay" and partial terms "debtor's delay" and "creditor's delay" and how they relate to the term of performance of a obligation. The work further focuses on analysis of the individual consequences of debtor's delay" and "creditor's delay. The closing part of the work contains comparison of the current Czech legislation with the international regulations such as UNIDROIT Principles of International Commercial Contracts (PECL); The Principles of European Contract Law and Draft of a Common Frame of Reference (DCFR).
Prohibited supplements and the associated risks of strength building.
Doležal, Tomáš ; Nekola, Jaroslav (advisor) ; Bunc, Václav (referee)
This bachelor thesis is aimed at issues in using prohibited supplements and the associated risks of strength building. The main aim is to find whether sportsmen are using any supplements to cultivate their strength and support growth of muscle mass. Secondly to determine if they are aware of effects to their health in using these supplements. The theoretical section is dealt with definitions of strength, kinds of strength and methods of development in achieving strength. Subsequently, there are examined refining strength capabilities by means of nourishment and food supplements. Eventually, there are inquired into prohibited strength-building substances and their influence on health. The practical section is focused on data and information collection and their subsequent processing. Outcome of data and information is reached by an electronic questionnaire. Key words: strength, cultivation of strength, prohibited substances
Assessment the effect of revitalizing measures of chosen peat bogs in the upper Vydra River basin on their water regime
Doležal, Tomáš ; Kocum, Jan (advisor) ; Kliment, Zdeněk (referee)
Assessment the effect of revitalizing measures of chosen peat bogs in the upper Vydra River basin on their water regime Abstract: Despite a number of research projects, the influence of peat bogs on the hydrological regime remains a largely unexplored topic. In the past, several peat bogs in the Šumava National Park were exposed to a very strong anthropogenic pressure. Subsequently, revitalizing measures were applied to mitigate the impact of human interventions, to stop the degradation of these precious habitats, and to reform the disturbed peat bog water regime. This thesis is focused especially on fluctuations of water table level and on the hydrological regime in the catchments of Rokytka and Cikánský Brooks. Thesis further develops the topic solved in author's bachelor thesis called "Peat bog revitalizing measures and their effect on runoff dynamics in the Otava River headstream area." It contains experimental research of the influence of drainage canals and revitalizing measures on water table fluctuation. It also aims to identify the extent to which meteorological factors contribute to changes in groundwater level and to assess the present state of revitalization measures and their influence on the runoff regime. Key words: peat bogs, revitalizing measures, Šumava Mountains, water regime
The Concept and Development of Strict Liability in Czech Tort Law and its Inspirational Sources
Lovětínský, Vojtěch ; Elischer, David (advisor) ; Doležal, Tomáš (referee) ; Petrov, Jan (referee)
The Concept and Development of Strict Liability in Czech Tort Law and its Inspirational Sources Abstract The thesis deals with an analysis of strict liability in Czech tort law taking into account the inspirational sources of its regulation, including in particular German and Austrian law, the Principles of European Tort Law (PETL) and the Draft of Common Frame of Reference (DCFR). Further, a historical and possible future development of strict liability is analysed as well as the risks for which strict liability is imposed. The thesis is divided into two main parts. The subject-matter of the first General Part is especially the concept of the strict liability and the reasons for its application. Further, some related problems are analysed in this part which are relevant for the legal theory as well for the legal practice (e.g. defences, contributory negligence, possibility of the concurrence of claims). The subsequent Special Part contains an analysis of the types of strict liability and consists of four main chapters. The first chapter deals with a short overview of the historical development of the strict liability in Czech tort law. In the second chapter particular types of liability in the effective Czech Civil Code are presented and critically evaluated. In the third chapter the author deals with some...
The methodology of expert analysis on the materials of criminal and civil court cases associated with the adverse outcomes of treatment
Zakharov, Sergey ; Dostál, Ondřej (advisor) ; Čeledová, Libuše (referee) ; Doležal, Tomáš (referee)
Objective. The development of the methodology of expert analysis ensuring comprehensiveness, completeness and objectivity of expert investigation in the criminal and civil cases associated with the adverse outcomes of treatment. Materials and Methods. For the purpose of the study the special program was prepared 'The comprehensive study of the content of the expert testimonies in the criminal and civil court cases associated with the adverse outcomes of treatment'. The continuous research method was used for the content analysis of the expert testimonies (116 units of observation), the selective research method was used when interviewing health care providers (50 units of observation) and lawyers specializing in medical law (50 units of observation). Results and discussion. The expert analysis should be considered an essential element of the expert investigation in the criminal and civil cases associated with the adverse outcomes of treatment, since it ensures the comprehensiveness, completeness and objectivity of expert testimony. For the purposes of expert analysis, the process of health care provision can be considered as an open process information system, the sequence of the implementation of therapeutic measures within it is conditioned by the character of diagnostic information, and the...
Object Shape Reconstruction Based On The Max(T,0)-Pulse Response
Doležal, Tomáš
This article presents an object shape reconstruction method based on the ramp pulse response. It is demonstrated that only such three backscattered responses obtained through simulations are sufficient to achieve realistic target images. The proposed imaging algorithm is validated on the shape estimation of an EM impenetrable 3-D object.
Hydrological function of peat bogs and peat water properties of the Vydra River headwaters
Doležal, Tomáš
The retention potential of landscapes, along with the water regime of spring areas, are important hydrological topics of research, particularly in the current context of increasing extreme drought frequencies. The present work is focused on monitoring the mountain peat bogs, which, due to their overall frequency of occurrence in the spring area of the Vydra river, represent a significant constituent of the rainfall-runoff process of the area of interest. The specific hydropedological features of the organogenous soils (Histosol type soil) provide the high retention potential of the area, however, the influence of these soils on the runoff process is determined by complex physicogeographical factors. The general opinion on the hydrological function of the peat bogs has changed in recent years and the most important factor in the runoff formation in the mountain area of the Šumava Mts. is now thought to be the actual saturation of the headwater, which is predominantly composed of hydromorphic and organogenous soils. The organogenous soils are significant water reservoirs and have an important impact on the landscape. However, they may also intensify the extreme values of the watercourses during extreme precipitation events. The fundamental part of this work focuses on detailed observations of the...
