Election of the president of Czech Republic ie terms of campaign financing

The aim of the work is to determine the cost-effectiveness for the presidency under its direct election in comparison to the number of votes received and assess the extent to which individual candidates complied with during the entire electoral process, financing conditions established by law.
The theoretical part defines basic terms are mentioned laws which govern the legal framework for financing elections of the president and also stated, what are the conditions for the presidential election in some European countries.
The practical part describes the process and results of the presidential election in 2013, thus the first direct presidential election in the Czech Republic and their financing.
In the conclusion is a comparison of the financing of individual candidates, evaluate funding system and suggestions for improvement.
The finding is that the amount of expenses incurred is not in direct proportion to the number of votes received and are also the shortcomings of compliance with the legislative framework of the election process.

The issue of the lottery law in selected company

The goal this Bachelor thesis is find out, how to influence legislation, which work with lotteries and with results of selected companies. In particular the Law no. 202/1990 Coll., about gambling. The gambling act became effective from 1. 1. 2017 replacing the previous law. We don't forget to aim at Act no. 187/2016 Coll., about tax on gambling, which came into in same time like the law about gambling. The author of the thesis tries to introduce the core issue of gambling with basic concepts. Another thing is regulation of gambling, which the author explains too. Primarily will be mentioned the main differences about stricter regulation, which was newly applied in Act no. 186/2016 Coll., about gambling. Also important are generally binding ordinance for Capitol City of Prague, which together with Law are regulating area of gambling. The theoretical part of thesis will focus analysis and area of gambling . In the practical part of thesis author will focus on selected part of Prague and further on one specific company, which is operating with lotteries and gambling. The author wants to find out, what will be changed with new the generally binding regulations for Capitol City of Prague, how these changes will be changed numbers of establishments and how these changes have an impact for company BANCO-CASINO, a. s. The results will be summarized with results of exploration at the end of this thesis.

The presidential election campaign financing rules from the perspective of the laws of the Czech Republic

Thesis deals with the topic of the financing of the presidential election campaign. In its first part is pointed out the position of President in the Czech Republic and the legislation his choices, both with efficiency up to 2012 (indirect election of the President), and especially with effect after 2012 (direct election of the President). The pivotal part of the submitted work examines the legislation funding the presidential election campaign, its gaps and shortcomings. It finally pointed out also from a practical perspective, when it is pointed out the violation of the legislation in this area by all candidates for the post of the President in 2013. In brief is then given an overview of the laws of certain European countries. Some of them may be the model for the Czech legislature, with regard to the amendments to the existing legislation. Indeed, this also means that the last chapter of custom text to be submitted to the work where the author documented criticism of the existing legislation, the financing of presidential election campaigns and proposals de lege ferenda.

Legal consequences of human gender-reassignment

This Bachelor Thesis deals with the issue of legal recognition of gender reassignment and its relation to human rights. First, it provides an overview of legislation that deals with this topic. It also contains the definition of gender identity, transsexualism and transvestism, development of transsexualism in the Czech Republic and the actual phase of a complete surgical sex change and of an administrative sex change, which includes alteration of personal data, documents, and especially changes to the personal identification number, to which this thesis is mainly focused. Sex change is also related to the termination of marriage, issues of personal status of human and property and family relationships.

The issue of public procurement financed by means of grants provided by the European Union

The thesis deals with the issue of public procurement co-financed through EU subsidies. The theoretical part in the first part focuses on the law of public procurement, its presentation in the Czech Republic and explanation of important terms that are related to public procurement. Another part is devoted to EU legislation and methodological guidelines regulating the area of public procurement co-financed by the EU. In the analytical part they are identified and evaluated the most common errors that occur in public procurement co-financed by the EU in the period 2009 - 2016 according to the Managing Authorities and intermediate bodies, which are complemented by national and European practices of the courts and decisional practice of the Office for the Protection of Competition. Another section contains an overview and analysis of the errors made by contract owners according to the Office and misconduct in public procurement under the Rural Development Programme and Operational Programme for Fisheries in the Ministry of Agriculture and the State Agricultural Intervention Fund in the years 2014 - 2016 according to the Supreme Audit Office. At the end there is an analysis of public procurement in the RDP 2014 - 2020. In conclusion, recommendations are made to eliminate errors and summarized results of the work.

The Public Procurement for the Supplies

The thesis deals with the theme of procurement of supplies in the Czech Republic from its beginnings to the present in the context of legal and economic developments. The current situation is analyzed on the basis of the Public Procurement Act, in connection with monitoring the preparation and adoption of new legislation. Legal issues will be extended by an overview of relevant laws and evaluate the problems in the formation of tender documents for the conclusion of framework agreements for the supply and reviewing compliance with the principles of the Act on financial control in public administration. Theme in the application of profiling on public procurement, focusing on a framework agreement designed to capture recurring delivery. The study is supplemented with practical experience in the field of public procurement for the conclusion of framework agreements, provides an analysis of the positive and negative aspects of this method of procurement, including proposed solutions. The practical part is elaborated on the basis of a comparison of the specific tender documents with the statutory legislation, qualitative research and secondary data analysis of tender documents for contracts to supply a valid framework contracts signed by the selected organization in the years 2012-2016.

Administration of public procurements in public research institutes

This thesis deals with the analysis of administration of public procurements in public research institutes.
The main objective is to evaluate current system of administration of public procurements in public research institutes in the Czech Republic, identification and treatment of risks connected to the given process, respectively.
The theoretical part is focused on explanation of basic concepts related on one hand to Law of administration of public research institutions nb. 137/2006, and on the other hand to public research institution as a legal form. Practical part then analysis the market of administration of public procurement with the focus on public research institutions and possible misconduct that may the whole process prolong and expensive. The Institute of Organic Chemistry and Biochemistry AS CR, v.v.i. is shown and analyzed as an example of public research institution.
In conclusion, the methodical procedure for administration of public procurement in public research institution is designed, this way the number of misconduct can be lowered down (according to the Office for the Protection of Competition). Simultaneously, this should attain decrease of wasting of public funds.

Problematika zadávání veřejných zakázek malého rozsahu

Tato diplomová práce se zabývá problematikou zadávání veřejných zakázek malého rozsahu a to se zaměřením na problémy, se kterými se musí potýkat zadavatelé 42. mechanizovaného praporu při zadávání veřejných zakázek malého rozsahu prostřednictvím elektronického tržiště Tendermarket a s problémy, které jsou spojeny s výběrem vhodného dodavatele. V teoretické části se seznámíme s pojmem veřejná zakázka malého rozsahu, jejím členěním a zmapujeme právní předpisy a nejdůležitější interní normativní akty (dále jen INA), které zkoumanou problematiku upravují v resortu MO ČR. Analytická část bude zaměřená na samotné problémy, se kterými se zadavatelé potýkají při zadávání a vyhodnocování veřejných zakázek malého rozsahu. Na jedné zakázce malého rozsahu bude vysvětlen postup zadávání zakázky v elektronickém tržišti Tendermarket. Následně budou vyhodnoceny problémy či nedostatky, které při tomto zadávání a vyhodnocení vznikly.

Resolving of insolvency of business corporations trough bankruptcy

The presented thesis tries to introduce the reader to the course of the insolvency proceedings, especially in bankruptcy proceedings. The theoretical part mainly discussed about the meaning and history of this institute, further aspects necessary for the commencement of insolvency proceedings and then there is described in more concise form the additional course up to the decision on the debtors bankruptcy. Subsequently, the author deals with the consequent procedure in cases where the debtors bankruptcy is solved by bankruptcy. Describes the course, focusing primarily on the sale of the debtors property and its subsequent allocation among the creditors until its conclusion, which is the submission of the final report by the insolvency administrator of the court, its subsequent approval and distribution schedule. In the practical part of the thesis the theoretical knowledge mentioned above is applied to the selected insolvency case of business corporation. In this part there are also pointed some potential problems and complexities that arose in this case. There is also described and analyzed the entire insolvency proceedings from filing an insolvency petition to the preparation of the final report by the insolvency administrator, that is the stage where the proceedings took place on the date of submission of this work. Furthermore, the author discusses the development and the number of insolvency proceedings in our country since 2008 when the new legislation of this institute came into force. On the same principle, the author also deals with the analysis of the most common types of obligations of business corporations.
