Activities of the Probation and Madiation Service of alternative sentences

1 Abstract Thesis deals with the implementation of elements of restorative justice in the Czech criminal law, especially in the prison system. The work identifies and analyzes the basic problems of the Czech prison system and their impacts on public policies in the Czech Republic, especially overcrowding of jails, and the way, how the state, and especially through the Probation and Mediation Service, solves this problem. This work analyzes, how successful is the implementation of alternative punishments, what tools the state has to reducing the number of people in prisons and how to reduce overcrowding in jails. In the work I also identify the role of the Probation and Mediation Service in the issue of alternative sanctions. In the work I also suggest, how to solve these problems.
Anti-corruption activism of the commercial sector from the point of view of political opportunity structure theory

The diploma thesis "Anti-corruption activism of the commercial sector from the point of view of political opportunity structure theory" Abstract The diploma thesis "Anti-corruption activism of the commercial sector from the point of view of political opportunity structure theory" was devoted to the structure of political opportunities in 1998 to 2012 in relation to manifestations of corruption in the Czech Republic and the role of the commercial sector in terms of anti-corruption involvement. This thesis aimed to find out what is the structure of the opportunities, that participants of the commercial sector can be use in order to influence anti-corruption public politics. Two periods were found from the period of time which the thesis focuses on, during which more fundamental manifestations of the commercial sector occurred. The first period was linked to accession of the Czech Republic to the EU, when presentation of the commercial sector most frequently took place via special-interest associations and tools of Commercial ethics and the concept of CSR supported by activities of the European Union. Alternative sanctions in the Czech Republic.

This diploma thesis deals with alternative sanctions in the Czech Republic. It primarily focuses on the cooperation between relevant actors during the process of decision-making about the type of sanction, its execution and supervision, and also concentrates on possible changes of its use after the amendment of criminal law in 2010. To give a complex view on given issue, the thesis also shortly focuses on alternatives to sanctions and diversions of criminal proceedings. System of alternative sanctions is framed by criminal policy and criminal law of the Czech Republic and factors that have influence on functioning of the system are determined. Those factors are multinational structures (OSN, EU, Council of Europe), level of registered criminality, forms of criminality and public opinion. Despite the fact, that Czech criminal law contains quite wide enumeration of alternative sanctions, there are still opinions that they are not used enough and that imprisonment is still preferred and it causes overcrowding of prisons and it is burden for state budget. Analysis of the measures against right-wing extremism of state and non-govermental oragnizations in the Czech Republic

This thesis is dedicated to the defense of the country against right-wing extremism. The first part describes the theoretical background, which is Karl Loewenstein's Militant democracy and its critics at the same time. Also it gives a definition of extremism, which is known to be a problematic concept. The development of Czech right-wing extremist scene is described briefly. The first part of the analytical section explores Czech legislation on the ground of Militant democracy criterions. The main point of this thesis is the analysis of concrete measures against right-wing extremism based on an expert survey. These measures come from both government and non-governmental organizations. This way the analysis reflects both dimensions theoretical basis - Militant democracy and its critics, that emphasize the efficient function of the nongovernmental sector. The measures are evaluated by their efficiency and furthermore analyzed by their pros and cons. The main goal of this thesis is to evaluate the measures and select the most effective ones.
Systemic corruption in Liberec

The thesis "Systemic corruption in Liberec. How to deal with it?" focuses on the problematics of systematic corruption and clientelism in post-communist society. It is launched as a case study (Yin 1994, 2003, Flyfbjerg 2006, 2001) whose frame remarkably exceeds ordinary corruption models (public office, market centered theory, public interest) and is based on systematic corruption model theories (Caiden, and Caiden 1977, Caiden 2003, Johnston 1998, Wallis 2006, Stefes 2004, 2007, Jowitt 1992 etc.), and eventually their effect emerged in the areas of the government system, civil freedom, social cohesion and public economy. Empiric part consequently covers both phenomena showing the case of the Liberec city hall, the research itself is bounded by the years 1998-2010, when the connection between the city government and construction lobby reveals in an intense political and medial point of view. The research is made to identify and prove the figures of systematic corruption and clientelism based on the individual affairs of political representatives, office workers and various economic entities. The Influence of a Short-Term Imprisonment on Prisoners with Custodial Sentence in the Czech Republic

This dissertation is dedicated to the issue of deficiencies of treatment programs in prisons of the Czech Republic for prisoners with short-term custodial sentence. In the theoretical part of dissertation is given the definition of short-term custodial sentence and is briefly described the system of treatment programs in the Czech Republic. Also in the theoretical part are described models of imprisonment settings by criminologist Ben Crewe. In the empirical part of dissertation treatment programs are classified by the models of imprisonment settings, described in the theoretical part. Classification is based on prison educator's evidences. Practical realization of treatment programs is also compared with the legislation. In the empirical part basing on evidences of prison educators and prisoners is also done identification of existing deficiencies that can be a barrier in effective implementation of treatment programs for prisoners with short-term custodial sentence. In the summary part of dissertation are given possible causes of defined deficiencies.

Prevention of crime within the city of Kladno

This diploma thesis deals with the crime prevention in the Czech Republic, particularly within the region of the Statutory town of Kladno. The introductory part includes the explanation of relevant terms related to criminality, and the criminality connections outline, criminology and crime prevention. This is followed by the analysis of legal norms, strategic documents, aims and crime prevention priorities at national and regional levels. Individual crime prevention management levels are described and staffing for crime prevention with the focus on Kladno Municipality is analysed. At municipal level the organisational changes caused by the need of preventive measures integration within the authority of Kladno are taken into consideration. The thesis also outlines the potential of synergic crime prevention impacts alongside the solution of social exclusion in the area of Kladno; current situation is reviewed. The empirical part of the thesis is based on the project plans for crime prevention in the period of 2009-2013. Social, economic and ethical aspects are analysed. Social aspect of alternative punishment

The final thesis deals with the issues of alternative punishments, the development of penal policy during the last twenty years, the identification of social factors related to inflicting alternative punishments, and with findings regarding different views on the effectiveness of alternative sanctions as one of the main tools of our sanctions policy. The theoretical part of the thesis consists of five chapters. The first chapter provides a historical excursion in the punishment issues; the second chapter presents the basic theoretical concepts which form a base for current punishments. The following chapters deal with the criminal policy development in the Czech Republic taking the existing legal regulations into consideration, with the current forms of alternative punishments used in the Czech republic, with defining the term 'social aspect' and 'efficiency', as well as with assessing the positive and the negative aspects of using such punishments. The practical part of the thesis is dedicated to interpreting and evaluating the data gathered by interviewing different professionals working in this field.
