Integrated pollution prevention and environmental protection

Thesis describes the latest legislation of integrated pollution prevention and control effective in the Czech Republic after 19 March 2013 including relevant European Union law especially Directive 2010/75/EU of the European Parliament and of the Council of 24 November 2010 on industrial emissions (integrated pollution prevention and control). First two chapters deal with the sources and principles of integrated pollution prevention and control (hereinafter only "IPPC"), focusing on the principle of a comprehensive approach to the environment and its integrated protection, the principle of prevention and on public involvement in the IPPC permit procedure. The fourth chapter explains selected basic terms of IPPC, such as installation, permit and Best Available Techniques (BAT). In the field of BAT thesis deals with the new status of the Reference Document on Best Available Techniques (BREF) in the IPPC permit procedure, with the procedure for the drawing up and reviewing of BREFs, with their structure and with the exchange of information on BAT. Principles of environmental protection and their application in international, European and Czech law

Úvodní část je věnována obecnému výkladu pojmu právního principu, stanovení výchozí definice a její zdůvodnění, závěrem je uvedena typologie principů. V této práci tedy pojednávám o principech jako vůdčích myšlenkách právního odvětví , které se vyznačuj í vysokou mírou obecnosti a tvoří rámec právní úpravy. Mají stěžejní nenahraditelný význam pro tvorbu, interpretaci i aplikaci práva. Principy hrají v právu klíčovou roli na všech úrovních: mezinárodní, evropské i národní, české. Představují nenahraditelnou pomůcku při tvorbě nejen právních norem, ale i nezávazných dokumentů, jenž mají obrovský význam zejména v mezinárodním právu životního prostředí , které svými požadavky mnohdy koliduje s tradičně pojímanou státní suverenitou i s ekonomickými zájmy států, a proto s e společný mezi státní konsenzus nutný pro přijetí norem "hard law" čas to nepodaří nalézt. Dále se zaměřuj i již na právo životního prostředí a třídím jeho principy podle míry jejich obecnosti do dvou hlavních kategorií na principy obecné (tedy takové, které mají dopad i na jiná právní odvětví než právo životního prostředí ; dále je ještě člením na nezměněné a modifikované) a specifické, jež jsou formovány specifičností předmětu práva životního prostředí, jímž je regulace lidských vztahů při ochraně životního prostředí . Legal regime of protected areas and protective zones to protect water

This diploma thesis deals with the legal regime of protected areas and protective zones used to protect water. The diploma thesis is composed of four chapters. Chapter one defines basic terms, a protected area and protective zone, in general. This chapter also contains a comparison of both institutes and their application in environmental protection. The second chapter deals with the sources of relevant legislation protected areas and protective zones to protect water. Chapters three and four are central of the thesis as they contain an interpretation of legislation of each types of protected areas and protective zones to protect water. For individual institutes is analyzed their concept, function, form and method of their determination and especially their special legal regime based namely on bans and restrictions regarding certain activities in the given area. Attention is also paid to various limitations of property rights to real estate in the protected areas and protective zones and to possible compensations for such limitations.
Legal protection of the ozone layer

107 Summary The Ozone layer of the Earth located in the stratosphere in an altitude of 20 to 50 kilometres is the important part of the gases surrounding the planet Earth. Its purpose is to absorb UV radiation that otherwise very negatively affects life on the Earth. During the twentieth century, this ability was weakened by the emission of substances proven much later to be very dangerous in this way. Until 1987, by various chemical reactions, in particular of chlorine atoms, the ozone hole has been formed over the South Pole of the Earth, not fully healed yet. In 1985, risk to human life led using the precautionary principle to the adoption of the Vienna Convention and subsequently of its implementing protocol including specific obligations especially the control measures of the production and consumption of ozone depleting substances and of the trade with them in 1987. The protocol was later modified by amendments and adjustments. This diploma thesis describes these acts with respect to their evolution and actual state of knowledge. Environmental protection instruments in Czech law

This diploma thesis deals with the instruments of environmental protection which are used in the Czech legal system. Thanks to these instruments, the state and other institutions try to assign the most effective environmental protection possible. We can divide these instruments into two main categories, direct and indirect. The direct instruments are divided into conceptual, administrative - law, vindicatory and voluntary. The indirect are represented by the economic instruments, which can be divided into instruments of positive and negative stimulation. The thesis also contains specification of the particular basic principles of the environmental protection and the concretization of the institutions responsible for the protection. Each chapter also contains a demonstration of how each particular group of instruments can be practically applied in the nature and landscape protection.
