Opportunities for author on the music market

Aim of my thesis was to create a practical manual for musicians, especially for authors, which would guide them through the copyright law, composition protection and principles of collecting royalties. My intention in the second part was to analyze current music market and find opportunities for musicians. The result of my thesis should be recommendation for both - authors and interprets how to protect their work and reach appropriate remuneration.

Impact of the authors' rights on the performing artist's profession

The authors' rights nowadays concern every individual. They significantly influence the performing artists, who use authors' works to make their living. This thesis analyses the specific impact of the Czech legal regulations on the professional musicians, describes the competences of the collecting societies, refers to the difficulties due to differences in the legal regulations on the international scale and defines musical theme as a new term in the legal context. The thesis proves the advantage of potential use of this term in both Czech and international courts practise.

Duševní vlastnictví a ochrana práv s ním souvisejících zaujímají v mezinárodním obchodě stále významnější místo. Tvorba nadnárodního legislativního rámce a vymahatelnost autorských práv jsou důležitými body jednání mezinárodních institucí. V této práci je předložen výčet nejdůležitějších mezinárodních úmluv v oblasti práva k duševnímu vlastnictví, jsou nastíněny klíčové body jednotlivých ustanovení a je naznačena jejich vzájemná návaznost. Na konkrétních příkladech je ilustrována aktuální míra porušování těchto práv a je poukázáno na nedostatečnou postižitelnost protiprávního jednání.
