Legal regulation of the renewable energy resources and their use

Title: Legislation of renewable energy sources and their use Abstract The presented thesis deals with issues of legal regulation of renewable energy sources with target on legal regulation of system of support in the Czech Republic. The thesis contains the overview of documents and instruments from international enviroment. As a result of the Czech Republic membership in the European Union the thesis presents instruments of union legislation which due to integration of EU member states legislation and due to marking out obligatory goals aims to opened unified and liberal energy market. The thesis describes historical development of this phenomenon from partial legislation to complex and sophisticated legislation and artificially formed systems of support including and puts them into context with social economic aspects of pursued period of time. Due to comparative method the thesis brings not only comparation of legislation in the course of time in Czech and European background but also evaluate them and try to estimate progress and find possible solution. One of the thesis targets is to provide the comprehensive view on legislation of renewable energy sources from businessmen points of view and put this relationship into context with institute of environment protection.
Legal regulation of creation and protection of Natura 2000 network

This diploma thesis deals with legal regulation of creation and protection of Natura 2000 network. Natura 2000 is a system of protected areas created in Member States of the European Union which is aimed at preservation and potential renewal of natural habitats and rare and threatened species of wild fauna and flora. The objective of the creation of Natura 2000 network is to ensure the diversity of species and ecosystems, primarily the rare and threatened ones. The network is composed of the Special Protection Areas (SPAs) designated on the basis of the Birds Directive and of the Special Areas of Conservation (SAC) designated according to the Habitats Directive. The introductory chapter deals with historical development of the nature conservation on the Czech territory up to the present and as follows it gives an explanation of the term the Natura 2000 network. The chapter 2 is devoted to the most significant international conventions related to Natura 2000. The Bern Convention has even inspired some articles of the regulation included in the Directives. Comparation of legislation of National Parks in the Czech Republic and the Republic of South Africa

1 Abstract The thesis whose subject is Comparation of legislation of National Parks in the Czech Republic and the Republic of South Africa deals In detail with the legislation of national parks, especially in comparison of the Czech legal system and the legal system of South Africa, but also with the international law and European Union law. The aim is mainly to analyze in detail the individual instruments and institutions that govern the environmental law in relation to national parks and to acquaint the readers with scope of nature conversation in Europe and Africa. The thesis also serves and explains the basic terms related to the territorial regulation of national parks and protected areas (prior to national parks) on both continents. National parks are the most important type of protected area; they are declare by the state and in the scope of nature conversation national parks are the most crucial mean of conversation. The regulation of national parks is embodied in the laws of individual states; in the Czech Republic it is the Act on the protection of nature and landscape of 1992 while in South Africa it is the Protected Areas Act of 2003. Legal regulation of the Environmental Impact Assessment (EIA) in relation to European legislation

The subject of this dissertation is the process of the Environmental Impact Assessment in relation to the respective European legislation. The dissertation aims at providing a comprehensive analysis of the current Environmental Impact Assessment legislation, including its historical, international and European contexts. The dissertation proceeds in five chapters. Chapter One outlines the general characteristics of the Environmental Impact Assessment procedure and the principles that govern it. Chapter Two examines the development of the Environmental Impact Assessment process in international law, with emphasis on the Aarhus Convention. Chapter Three focuses on the anchoring of the procedure in European law. The core part, then, is Chapter Four, which delineates the separate phases of the Environmental Impact Assessment process as defined in Czech legislation. In the last chapter, the expected changes in the concept of the Environmental Impact Assessment are sketched.
Implementation of the Third energy package into the legal order of the Czech Republic

Implementation of the Third energy package into the legal order of the Czech Republic Summary This thesis discusses the implementation issue of the Third energy package, also known as the Third liberalization package, into the Czech national law. It consists of three regulations and two directives of the European Union, which determines the energy politics both on the European level and on the level of the member states. The first part of this thesis describes the ancestors of the Third energy package and their accomplishments or failures together with reasons for creating the next generations of liberalizing legislation. The author describes the liberalization in the form of the legal, functional and accounting unbundling separately for electricity and gas industry at the European level, and then the implementation at the level of the Czech legislation. In the next chapter it is further explained, what were the European legislator's incentives for creating the Third energy package, and what new institutes it stipulates. Public guards and their role in the environmental protection

This diploma thesis deals with public guards and the role they have in environmental protection. Firstly, the thesis focuses on the explanation of the concept of public guards, their historical development and present legal regulation. Secondly, the thesis deals with particular public guards, which are hunting guard, forest guard, fishing guard and nature guard. Their legal regulation and evaluation of their work is discussed in separate chapters. The next part of the thesis is concerned with The Public Guards Bill 2002. Finally, the thesis deals with a critical evaluation of the role that public guards have in environmental protection and proposes several solutions for the improvement of their work. The aim of this thesis is to provide a comprehensive analysis of public guards and to suggest solutions for the improvement of their activities.
Selected issues of nature and landscape protection in Czech law (The mining towers in Microregion Frenstatsko's case)

This diploma thesis deals with a historical development of the nature preservation. Then it shifts its focus to various commitments emerging from the international as well as EU laws. At the international level, the work individually describes several international contracts related to the preservation of natural ecosystems. Within the scope of the European law, the thesis focuses on the realization of the nature preservation, using the system called Natura 2000 and its factual implementation into the Czech law. The text also examines the nature preservation and its impacts in the constitution of the Czech Republic. After a brief introduction to the law no. 114/1992 Coll., on the preservation of nature and landscape, the work in detail analyzes individual categories of general and specific territorial preservation. Finally, the thesis examines the case study on the mining towers in the micro-region Frenštátsko in the context of several questions related to the preservation of nature and landscape.

- 1 - Abstract The theme of the thesis is "Development (building) procedure and environmental protection". Between the aims of this theses belongs analysis of the construction proceeding according to Building act, further especially evaluation of contemporary legal adjustment environmental protection with connection to construction proceeding and disquisition about main instruments in environmental protection. The thesis deals with environmental impact assessment procedure, objections of the participants in construction proceeding, public participation in contruction proceeding and binding standpoints. The thesis is systematically composed of three chapters. The first chapter focuses on legal adjustment and main principles of environmental protection. Chapter two describes object, subjects and particular phases of construction proceeding foccused on building authority activities. The third chapter deals with particular instruments of environmental protection in construction proceeding. Finally, the thesis comprises a summary of contained conclusions.
Legal regulation of the protection of plants and animals

Legal regulation of the protection of plants and animals The subject of this thesis by the title " Legal regulation of the protection of plants and animals" are selected, the most significant legal standards, laying out the problematic of fauna and flora protection and their analysis in order to create a comprehensive scope of fauna and flora legal regulation in situ both on international, European and domestic level of law. The thesis is divided into four parts. The first chapter introduces the structure and extensity of the fauna and flora protection problematic, whereas it contemplates over the term biological diversity. The next chapters successively describe the legal regulations of fauna and flora on the international, European and domestic level of law. The introduction is always there to mention historical development and related standards that have given the present legal regulation its form. It is followed by summary of the most significant standards of the legal regulation in effect. To conclude my thesis, I am summarizing and determining whether the system of legal standards in effect truly results in the objective of legal regulations of fauna and flora protection, primarily in stopping the decrease of biological diversity and its restoration in the future.
Protection of environment in criminal law

The final thesis is focused on the environmental protection in the Czech republic in the field of criminal law. Chapters are concentrated on the explanation of the basic elements, relations and principles for better orientation in the issue of criminal law environmental protection (Chapter 2). It also analyzes the evolution of the environmental protection in the Czech republic, in the European Union and on the international level in general (Chapter 3). The final thesis is mostly focused on the subject of the substantive criminal law (Chapter 4). The elements of a crime are defined and analyzed. Furthermore the attention is directed towards a criminal liability and sanctions in case of a violation of the environmental protection rules covered by criminal law justice. In its final chapter, the thesis concentrates on the procedural part of the criminal law (Chapter 5).
