Legal regulation of water quality protection Abstract This diploma thesis deals with the legal regulation of groundwater and surface water quality protection. Its aim is to analyze the legal regulation of water quality protection, together with the evaluation of legal instruments and the proposal of particular changes that could potentially lead to intensify protection of this indispensable component of environment. The diploma thesis is divided into five chapters. The first chapter deals with legal nature of waters, water management, acquiring ownership of water and the historical context of the emergence of legal norms regulating the area of water quality protection. The second chapter of the thesis is devoted to the international legal regulation of this problematics. Chapter three deals separately with the legal regulations of the European Union, their creation, application and significance for national law. The fourth chapter of the thesis discusses legal instruments for water quality protection, their division and application. This chapter also deals with the legal responsibility for water protection. Legal regulation of ex situ biodiversity conservation Abstract This thesis focuses on the legal regulation of biodiversity conservation at international, European and mainly national level, in relation to ex situ conservation. The aim of the thesis is to introduce and provide an overview of the legal regulation of biodiversity conservation with a focus on ex situ protection of species of animals and plants. The secondary objectives of the thesis are de lege ferenda considerations in response to the identified shortcomings of the legal regulation in the Czech Republic, together with a comparison of selected provisions of the Slovak and Czech legal system. Overall, the thesis is intended to encourage reflection on the importance of biodiversity conservation and to focus attention on programmes, facilities and other methods of addressing ex situ protection. Legal framework of the species protection in the Czech Republic Abstract The diploma thesis deals with the legal instruments for species protection of plants and animals applied in the Czech Republic. In the introduction, he defines species protection and its position in the framework of nature and biodiversity protection and addresses the issue of the concept of species in a biological and legal context. The following is a historical overview of the development of species protection in the Czech territory from the oldest legal regulations adopted in the 19th century to 1992, when the current legislation came in force. The general part of the work ends with an overview of current legal regulations relevant to species protection of plants and animals, namely international, European and Czech regulations. The key part of the work is devoted to the description and analysis of the instruments of general species protection and special species protection according to the Nature and Landscape Protection Act. 9 Legal regulation of wild animals in human care Abstract This diploma thesis deals with the legal regulation of wild animals in human care. It outlines the related terminology, legal resources and individual legal provisions that are relevant to the topic of this diploma thesis. It also defines specific ways of the treatment of wild animals, the possibilities of their acquisition into human care and breeding. The diploma thesis in detail analyzes selected entities that breed wild animals. That means rescue stations (specifically their care for handicapped animals), zoos, circuses (namely their training of animals), as well as entities that experiment on animals. For chosen entities, it deals primarily with their obligations under the wild animals legislation. The last part then deals with the issue of liability in relation to wild animals. In the context of civil liability, it means both damage caused by the animal and damage caused to the animal itself. The diploma thesis also deals with administrative offenses based on the Act on the Protection of Animals Against Cruelty and the Act on the Conservation of Nature and Landscape, as well as penalties that can be imposed under these acts. 1 Legal aspects of pet animals breeding Abstract and key words The subject of this diploma thesis is the issue of pet animals, especially dogs and cats. The diploma thesis focuses on the development of legislation concerning these animals and the obligations of breeders. In terms of content, the work is divided into six chapters. The first chapter defines the principles applied in animal protection law and the basic concepts of this work, which are animals, pets, breeders, breeding and pedigree. The second chapter provides a brief overview of the instruments used in environmental protection, with an emphasis on animal protection. The third chapter deals with the responsibilities of the breeder, where the civil, administrative and criminal liability is discussed in more detail. The chapter examines all statutory obligations whether they applied equally to dogs and cats breeders. The subchapter on criminal liability also contains a comparison of previous and current legislation. The fourth chapter presents the bodies operating in the field of animal protection and their competencies. Legal regulation of the operation of zoological and botanical gardens This thesis details the current state of the legal regulation of the operation of zoological and botanical gardens. Given the ever more pressing need to preserve the biodiversity of the natural environment, the role of zoological and botanical gardens is increasingly coming to the fore. The appropriate level of regulation should enable the operators of these facilities to make the most effective contribution to the conservation of endangered flora and fauna, subject to compliance with all legal conditions. Zoological and botanical gardens are significantly involved in ex-situ species conservation, i.e. outside the natural habitats of species, in particular by breeding endangered species in the most natural environment possible or by cultivating endangered plant species in order to protect the gene pool, and in-situ species conservation, i.e. directly in their natural habitat, by returning bred and reared endangered individuals back to the wild. Sustainable development of the territory as one of the goals of spatial planning in the Building Act Abstract Spatial planning has a major impact on sustainable use of land. In relation to sustainability, land can be understood as soil, i.e. the substrate of fertility, and as a carrier of other natural resources, which include water and minerals. Land use also affects other components of the environment, such as air or fauna. These basic components of the environment are essential for human existence. Territorial changes can result in irreversible effects on these basic components of the environment. At the same time, territorial development is an integral part of our society and our economy. Spatial planning is regulated primarily by the Building Act, which has identified as one of the main objectives of spatial planning the development of the territory, which consists in a balanced relationship between favorable environment, economic development and cohesion of the community, and which meets the needs of the current generation without threatening the living conditions of future generations. Zoological and botanical gardens within their legal framework Zoological and botanical gardens date back to antiquity. Their long evolution has seen the relative importance of their functions change. Nowadays, zoological and botanical gardens fulfil a number of significant roles, with their contribution to endangered species protection and biodiversity conversation gradually having gained prominence. With the natural habitats of wild flora and fauna disappearing, it is zoological and botanical gardens that provide pro- tection by means of ex situ conversation, i.e., outside the natural habitat of these organisms. In the Czech Republic, zoos operate within a legal framework that consists primarily of Act No. 162/2003 Coll. on zoo regulation and amended acts, which implements the Coun- cil Directive 1999/22/EC of 29 March 1999 relating to the keeping of wild animals in zoos. The Act has introduced a licensing requirement for zoological gardens. It stipulates that zoos shall only be operated by a holder of a valid license granted in accordance with this Act by the Czech Ministry of the Environment. Right to a healthy environment in the case-law of the European Court of Human Rights Abstract The thesis deals with the right to a healthy environment as protected by the European Court of Human Rights. The thesis aims to provide a comprehensive overview of the ECtHR case-law on the right to a healthy environment, to identify the main characteristics of this right and the ways the ECtHR uses to protect it and to assess the strengths and weaknesses of the ECtHR approach. The second objective is to place the ECtHR case-law in the context of international law and other regional instruments and to identify how they influence the ECtHR's decision-making. On the basis of this information, the thesis asks a broader question of whether the ECtHR can effectively contribute to the protection of the right to a healthy environment in the 21st century, particularly in the context of climate change, or whether an explicit enshrinement of the right to a healthy environment in the Convention is potentially appropriate. 1 Abstract This Master's thesis entitled Legislation on treating animals in human care compares Czech and Australian legislation in selected aspects of three categories of animals in human care - farm animals, companion animals and animals used for scientific and other research purposes. The thesis is composed of 5 main chapters. The first chapter describes sources of law regarding treating animals in human care from the perspectives of international law, European Union law, federal Czech law and Australian law. The second chapter explains basic terms - an animal and its legal status and animal in human care in Czech and Australian legislation. The third chapter focuses specifically on farm animals as a category of animals in human care as it is detailed in Czech and Australian legislation. The fourth chapter deals with companion animals in both countries' legislation. Finally, the fifth chapter describes the legal protection of animals used for scientific and other research purposes in Czech and Australian legislation. .
