Resume - Care for the employees The purpose of this diploma thesis was to summarize the legal regulation of employees' care in the Czech Republic. The current competitive environment forces businesses to innovate with the aim of reaching sustainable competitive advantage. Within the invisible assets, the human factor is getting more and more to the centre and becomes the leading factor which influences company's efficiency. That is why the importance of questions concerning personal tasks is growing. In this context, issues concerning employees' care are also discussed to be an indivisible part of company's social policy. Even though the employees' care is in the Czech environment limited only to fulfilling the legal requirements, many businessmen start to realize the importance of quality employees' care for the company - mostly thanks to international standards in foreign companies. All of these matters reflex not only in the real company's behavior (employers), but also in the current development of legal regulations, that they regulate in terms of employees' care. The legal regulation is currently being gradually liberalized; it solves only the basic issues and suggests which areas should be in the centre of attention of employers. Zhodnocení platné právní úpravy Systém sociálního zabezpečení (sociální ochrany) , ve vztahu k osobám se zdravotním postižením, jev ČR v posledních letech reformován a rozvíjen s cílem poskytovat soubor dávek a služeb primárně podporujících sociální začleňování těchto osob. Daří se tak postupně vytvářet kvalitnější, modernější, dostupnější a efektivnější systém sociálních dávek a služeb odrážející změny ve společnosti a srovnatelný se systémy ostatních členských států EU. Jednotným rysem nově budovaných a reformovaných subsystémů sociálního zabezpečení se stala snaha státu odstranit dříve užívaný model plošného pojetí (výplata, poskytování) institutu sociální podpory ve smyslu cílené ingerence ve prospěch osob a rodin objektivně i subjektivně nejvíce zasažených zdravotním postižením. Prováděné úpravy systému sociálního zabezpečení by měly vést k cílené a vědomé diferenciaci, prováděné podle závažnosti a důsledků zdravotního postižení, jejímž výsledkem by mělo být sociální začlenění osob se zdravotním postižením. - 7 - Abstract - Employment of people with disabilities The thesis deals with the protection, rights and opportunities of employing disabled persons in the Czech Republic. It uses the information from the public-available sources and from the licensed sources available to all students of the Faculty of Law, Charles University. The thesis is divided into several parts, as current regulation in the international law, the history and current regulation in the Czech republic and in short practical part concerning real situation on the Czech labour market. The thesis follows the legislation at all levels and is structured similarly to the hierarchy of legal norms. First I deal with the definition of the concept, as has been altered over time. In a follow-up chapter are comprehensively analyzed the various international conventions that seek to identify and define a group of disabled people and set up for this group the broadest possible rights, and on the other hand, to define discrimination against such persons and to eliminate it. Social security and legal protection connected to maternity in the Czech Republic and the European Union The purpose of this master's degree thesis is to give a comprehensive overview of the current situation for pregnant women, women on maternity leave and parents on parental leave, including the protection of their rights provided by the employment laws in the Czech Republic and the European Union. The thesis is composed of an introduction, the main text and a general summary. The main text is divided into two parts. The first part deals with Czech legislation, covering all of its aspects related to maternity. It starts with development of maternity and parental benefits in Czechoslovakia and in the Czech Republic, but then focuses on the current legislation, mainly on the Sickness Insurance Act (maternity benefits, compensation benefits in pregnancy and maternity), State Social Support Act (parental benefits, maternity grants) and the Labour Code (maternity and parental leave, protection of women at work, etc.). - Agency employment The name of my diploma thesis is the agency employment. Nowadays, the institute of agency employment is a widespread phenomenon on the labour market. It is a very popular institution for employees as well as for employers, which is being changed under the demand of society needs and according to valid legislation. I have chosen this topic due to its timeliness and flexibility with which the agency employment reacts to the growing unemployment rate. Since the capacity of the agency employment is very vast, this diploma thesis aims to approach the fundamental issues and concepts relating to it. The thesis is divided into 6 chapters dealing with different aspects of agency employment. The first chapter provides the basic notions of agency employment, defines key terms associated to it. The second chapter focuses on the historical development of agency employment. It also outlines the view of international adjustment of agency employment, gives a short excursion into European legislation and provides an approach of the valid legislation in the Czech Republic.
