The influence of education on the role of mediator performance

(in English): This diploma thesis deals with the issue of alternative dispute resolution, mediation in non- criminal matters. The mediation is estabilished in the Act on Mediation and amending certain other acts (the Act on Mediation) No. 202/2012 Coll. in the Legal Order of the Czech Republic, that is the main the aspect in this thesis. This actual topic, (the issue is that it is relatively a new law, which came into effect in September 2012), deals with the personality and educational attainment of registered mediators, particulary prerequisite for the performance of the profession of a registered mediator due to the mentioned law and it examines and compares effeciency in the mediators' exams in the Czech Bar Association and the Ministry of Justice of the Czech Republic according to the Ordinance No. 277/2012 Coll., about the trials and rewards of mediator. The main goal of this diploma thesis is to find out by means of quantitative research if there is a difference between registered mediators with different previous university education and how it shows in mediation process. The teoretical part of the diploma thesis is devoted to description of the mediation as an alternative dispute resolution, defining the role and duties of mediators and the system of education of mediators.
Mediation as a Profession

OVERVIEW This study deals with the situation of mediation in the Czech Republic. Mediation began to develop as a modern field during the 1990s. With the adopting of Act No. 202/2012 Coll. on Mediation, partial definitions were give for what mediation is and for the conditions under which it can be provided. Nonetheless, the situation in mediation is still very complicated. The study therefore presents a unified overview of what mediation is, of the principles upon which it is based, and of how it is used in practice. It introduces the role of a mediator and of the demands that must be satisfied for the performance of mediation, and it describes how the professional standards and code of ethics for mediators are established. By comparing the profession of an attorney to that of a mediator on the basis of the identifying characteristics of an expert profession, it determines whether mediation is a separate profession or a method that is useful in other fields.

The study therefore presents a summary overview of what mediation is, upon which principles it is based, and how mediation is used in practice. The study explains the role of a mediator, what requirements must be met for a person to become one and discusses limits set by professional standards and ethical code of mediation. By comparing the profession of an attorney to that of a mediator on the basis of identifying characteristics of the two professions, this study aims to determine, whether mediation is a separate profession or rather a method applicable also in other fields. The differences between the work and activities of a mediator and an attorney are illustrated on a divorce case.

Integration of immigrants from Arabic countries settled in Prague for the long term or permanently

In my thesis I summed up the basic theoretical and practical knowledge about adaptation/integration of immigrants, integration policy and social work in the process of integration od immigrants, which i took from actual professional literature. I was also engaged in the influence of arabic-islamic factors in the integration process and actual situation of islam in the Czech society. I came out of the presumption, that the members of the target group can be negatively influented by unfair attitudes of majority and media, which usually come from the lack of information and can have specific needs and problems, on which it is necessary to react in an adequate way. By controlled structured interviews I realized pilot study into the target group, with the goal to gain information, useful for other researches and to consult the integration history of individuals, focusing on their specific needs in process of integration and forms and measure of their satisfaction and to indicate other possible fields of creation and application of integration arrangements, connected with the utilization or creation of capacities from both the side of majority society and immigrants theirselves.
