The Bachelor's thesis deals with alternative sentences in Czech criminal law. The first part focuses on explanation of term and purpose of punishment and alternative sentences, states advantages and disadvantages of alternative sentences and overviews their application. The second part focuses on legislation of chosen kinds of alternative sentences in detail. The last part is constituted by my own research, which concerns of public awareness of alternative sentences and public opinions on them.

Research of offenders upon release vs. in prisons : advantages and disadvantages

Forensic research, which uses interviews with offenders is always difficult and has many challenges. These challenges come from the offenders themselves but also from the environment in which the research take place.The collection of data in prison is difficult but also includes aspects which are predictable and can be controlled. On the other hand research of offenders after release is unique and includes many problems and situations. This article will concentrate upon the comparison of advantages and disadvantages of research in prisons vs. research of released offenders. We will discus such topics as selection of sample, reward system, motivation, ethics, security etc.

THE PROBATION AND MEDIATION SERVICES IN CR

My thesis concerns the process and development of Probation and Mediation Service in both Czech and international context. The theoretical part firstly deals with explanation of main expressions of probation and secondly informs about its historical development. The following part explains Restorative Justice, because it is the starting point of the establisment of the institute of Probation and Mediation Service. This part also defines the idea of Restoration Justice and describes the principals, programs, importance and targets of Restoration Justice. Next part of the thesis deals with Probation and Mediation Service in both Czech and international context. It also describes the cooperation of Probation and Mediation Service with authorities and other institutions. It informs about targets and functions of this service, rights and duties of the office workers and assistants, tools and methods of Probation and Mediation Service workers. The last part of the thesis concerns probation and mediation activities. The following part shows the activities and carrying out the role of Probation and Mediation Service in practical examples to understand it clearly and easily. Casuistries 1, 2, 3 shows the activities of Probation and Mediation Service in mediation area. Casuistries 4, 5, 6 shows the activities if probation. The target of this thesis is the overall description of the function of Probation and Mediation Service with the help of bibliography and the act No. 257/2000 of the code about Probation and Mediation Service. The thesis answers the initial research question: What is the function of Probation and Mediation Service in the Czech Republic? In the research part of the thesis I chose the qualitative research strategy and document analysis for gathering the information and searching for the research question. I used the questioning method within the researched group. The questioning of the workers of Probation and Mediation Service pursued during February 2013. The questioning concerned the examined probation and mediation examples with respect to intructions regulating the procedure of the office workers and assistants PMS ČR in the area of performance of supervision over violent crimes perpetrators and the Methodic Standard PMS ČR in the areas of preliminary proceedings and criminal trial. The document analysis was created by individual mediation and probation examples. Three examples were chosen from mediation area as well as three examples were chosen from probation area. The result of the thesis concentrates on the description of the process of individual cases.The conclusion of the thesis contains the function of Probation and Mediation Service of the Czech Republic, the summary of individual cases and results and evaluation of the overall contribution of the thesis.

Providers of Community Service Possibilities in Tábor Region

The work deals with potential providers for execution of punishment by means of community service in Tábor region. It is a possibility of newly arisen providers in neighbouring municipalities of the town of Tábor, which are not registered at PMS CR. The theoretical part describes history of alternative punishments which is where the punishment of community works belongs to. In brief there are characteristics of Probation and Mediation Service and its objectives. Further it involves pertinences and activities of the PMS worker during his/her work with the client both before and after the court decision. The work also mentions health protection of persons serving their sentence. The theoretical part is concluded with the chapter about currently arising providers for execution of punishment by means of community services and things like how to find out which municipalities and towns are at the register, what they have to do to become providers and what pertinences they have to follow and how to cooperate with the legal client. The practical part contains analysis at the non-registered municipalities in Tábor region, their possibilities to provide execution of punishment by means of community services. Further there are particularities concerning the selection of a person who could be granted with the possibility to be provided with this in their community. The result is a kind of profile of a convenient person for providing the execution of punishment by means of community services. Majority of the newly addressed municipalities would be willing to provide the person with the chance to execute the punishment. They would prefer a manually skilful Czech citizen ? a middle aged man between thirty and fifty. At the same time they would also enable the execution of the punishment to juvenile people in most cases. On the other hand people with any kind of addiction would not have many chances as well as people who should be recommended to execute the work at weekends. With the exception of winter season all the others had similar representation. In most cases municipalities would be willing to establish contacts with the Probation and Mediation Service. In connection with the declaration of the partial amnesty in January this year almost all municipalities mean that it affected the execution of punishment by means of community service but rather negatively.

The probation officers work with clients of probation and mediation service with a focus on ethical conflicts

The work deals the terms probation, mediation, probation officer and ethical conflict. The diploma is trying to describe the work the probation with clients of Probation and mediation service. What it task of the probation officers, what knowledge have to for performance ones profession. Distance describe, what kind of ethical conflicts he needs to solve while working with clients. I highlight the posibility of connection to the law number 257/2000 about probation and mediation service. This it in the theoretical part. In the practical part I descrie the ethical conflicts occur in the practice of the probation officers.

The probation and mediation service, alternative punishments in the Tábor region.

The submitted bachelor degree essay deals with activities of the Probation and Mediation Service and alternative sentences in the region of Tábor. The main purpose and question at the same time was to find out the most frequent types of alternative sentences served at liberty and places where convicts could serve their sentence. The theoretical section describes the activities of the Probation and Mediation Service and terms related to this Service. It also comprises types of punishments, mostly the alternative ones, listed in the Criminal Code no. 40/2009 Coll. as amended. This section also contains a summary of Act no. 257/2000 Coll. on the Probation and Mediation Service. The practical section comprises two parts. The first part deals with the quantitative research; the questionnaire technique was applied whereas questionnaires were submitted to members of the Czech Police and to employees of the Probation and Mediation Service. 31 respondents participated in this research. In the second part a qualitative research by means of the non-standardized semi-controlled dialogue technique was performed. Four respondents who employ convicts serving a sentence at liberty participated in this research.

The work of Probation and Mediation Service with a group of people on parole and under police supervision

The present bachalor{\crq}s thesis titled The work of Probation and Mediation Service with a group of people on parole and under police supervision deals in detail with the activities of the said institution in the Czech Republic. Long-term sentence have no positive results, therefore alternatives are being sought, alternatives that would replace traditional forms of criminals´ punishments. A large contribution has been seen in activities carried out by the staff of Probation and Mediation service. Thanks to it, many of those condemned are allowed to accept another/alternative form of punishment apart from imprisonment. Theoretical part of the thesis gives an account of the activities performend by Probation and Mediation Service in the Czech Republic, it describes its origins, organizational structure, principles, objectives, and function. The thesis also dwells on some projects the Service is participating on and which are essential for reintegration of the people released from prison. The research part of the thesis presents a quantitative survey that employed a method of questioning using the technique of semi-standardized (semi-conducted) interview, and a method of content analysis using the technique of secondary data analysis. The surveyed group contained the total of 15 clients of Probation and Mediation Service in České Budějovice. The aim of this work was to find out whether the people released on perole have a chance to come back to their original family bacgrounds, if they can find jobs and shelters, the impact of the punishment on the family as a whole, the amount of information they have, and the positive and negative aspects they saw in being sentenced and sent to prison. The findings of the survey are as follows: If the prisoners released from prison heve a functional family background even befor they started their imprisonment, they are welcome to come back even after having been released from prison. Upon their release, they tend to find some dwelling and proper job. The least negative impact has been detected in connection with relations between parents and children, noticeably negative impact has been observed in connection with relationships between partners. The amount of economical information provided for people released from prison is insufficient. The positive aspects of imprisonment include lessons the prisoners learn from their mistakes, and tendency to emphasize family relations. The negative aspects of imprisonment include mainly damaged family relations, the loss of a close person, the feeling of life loos, and stigmatization.

The status of probation and mediation services in re-socialisation of romany delinquents.

The subject of this Bachelor essay is the role of CR probation and mediation service in re-socialisation of gipsy delinquents. The text outlines history and presence of gipsy population in the Czech Republic, their segmentation and life style. Attention has been paid to activities of Sdružení pro probaci a mediaci v justici, o. s. (Association for Probation and Mediation in Justice). In addition it includes information on the mission, objectives and principles of probation and mediation activities. In addition there is a list of principles and areas of activities. The objective of this work is to map the role of probation and mediation service in re-socialisation of gipsy delinquents, including partial objective which is to identify if increased success of re-socialisation is affected by improved work of probation staff and involvement of professional and laic public. The practical section of this work applies a quantitative research in the form of secondary analysis of statistic data and a questionnaire.

Analysis and development of IS/ICT solution for project Sanace dluhů in the Czech republic

This paper describes the analysis and development of IS/ICT for the project Sanace dluhů in the Czech republic which is being realised by The Association for Probation and Mediation in Justice in cooperation with Czech Probation and Mediation Service and Swiss association VEBO. The goal of this project was to design and realize the IS/ICT support for project Sanace dluhů. In order to meet this goal many activities had to be performed such as designing the architecture of the information system, programming the IASW and the creation of documentation and training of future users. The first part of this paper describes the process of choosing the methodology and continues with more detailed description of the chosen methodology and with the description of how the methodology was adapted to fit the project. In this part there are also mentioned the agile techniques and models used during the analysis. In the next chapter the author describes and documents the analysis of clients' requests and the present state. Following chapters describe among other topics the design of the final solution, selected topics dealing with the application development and with the process of delivery of the developed solution to end-users. This part of the paper also discusses the future possibilities of extending the application. Author's contribution lies in performing the activities specified by the chosen methodology and in presentation of their outputs. In the process of creation of this paper the author understood the project Sanace dluhů, thoroughly analysed the requests for its IS/ICT support, reacted on the changes in requests and created a product based on these requests that fulfills clients' vision. Author then put the product into operation considering both hardware and software and trained its users.
