Indemnity and Debt Collection in the Case of a Sole Trader

This bachelor thesis deals with the problematic of security and enforcement of claims after the due date. Theoretical part works with notions like claim, debtor or creditor. Further of it deals with creation, cover, enforcement and extinguishment of a claim. In terms of enforcements it distinguish out-of-court and court settlements. Lastly it deals with economical, accountant and tax aspects of a claim. The analytical part contains an analysis of economical situation of the chosen contractor. Further of it analyzes his claims after the due date, which were created, in a selected period, during his commercial activity. The final part set measures, which could lead to improve of cover and enforcement of claims after the due date.

In this thesis, the reader is familiar with th problems of consumer loans connected with insolvency petition. The thesis contains several chapters and subchapters are dedicated to consumer loans.On the basis of literature and website decribes the development and history of banking, it is defined by consumer credit and its classification and the outline th most important laws. The main goal of this thesis is the analysis of consumer credit, and their effect on the number of insolvency petitions. Practical part is dedicated to free analyzes general analysis of banking and non-banking institutions providing consumer loans and a third analysis focuses on the profile of individual borrowers. Finally, the work is a comparison and evaluation of surveyed data.

This diploma thesis deals with the amendment of the Standard IAS 17 - Leases, which is result of negotiating between the International Accounting Standards Board and the Financial Accounting Standards Board. This thesis is primary focused on the lessee's impact of issues and deals with situation, when the contract contain an element of uncertainty, specifically the possibility of using option for extended or variable payments. First part is devoted to the theoretical information about leasing based on current Standard IAS 17. Second part of this thesis describes the historical background of the Project Leases and explains the new proposal of methodical approach. In the third part there are applied the new knowledges described above and assessed the impact of new methodology to the items appeared in balance sheet and income statement.

The Bachelor's thesis deals with securing and collecting debts. The theoretical part of thesis includes the explanation of not only legal, but economic, accounting and taxation concepts related to issues of debts. The analytical part of thesis describes the entrepreneurial subject called Logsys, s r.o. and focuses primarily on their existing securing and collecting debts. The particular recommendations of the most effective way how to secure or collect debts are included in suggestions of solution.

The final part describes my proposals to improve current system of debt security and recovery.

The main part aims to clarify the essence of extra-judicial and judicial recoveries of claims. These claims are seen from the accounting, tax and economic perspective. The analytical part characterizes the selected business subject and features analysis of current securities and recoveries of claims after their due date. The final part of this work includes the most suitable arrangements for increasing the efficiency of methods of recovering claims and suggestions for improving their security.

Analytical part describes the monitoring of business entity in which it focuses on the problems associated with the recovery of debts and their existing solutions. The last part describes my proposed starting points, as the best and most ecient way to recover the debt, but also how it is already in the emergence of a well secured.

The work also includes concrete proposals for streamlining and improving the methods and procedures for enforcement and security claims.

It also deals with methods of debt collection according to the Civil Procedure Code, Enforcement Code and arbitration procedure. The thesis analyzes overdue receivables in the company Poličská stavební, s. r. o. and submits proposals for more effective debt collection in this company.
