Civil liability for damage caused by sport activities

1 1. Brief English Résumé This dissertation thesis deals with civil liability of the athletes for injuries caused by them during course of sporting. As such a topic does not find too much coverage within the Czech legal science (and practice as well) the thesis aims at bringing a light of knowledge to this dark scientific area. For the area of possible mutual interaction of sport and law is immense, the thesis chose to cover only those topics and areas that are crucial for shedding a light upon and better understanding of the athletes' civil liability for damage (injuries). The thesis therefore, after basically examining the relation of law and sport in general, defines the notions that are of basic nature for further exploration of the athletes' civil liability, such as notion of sport, the examination of the athlete's legal nature (entrepreneur, employee etc.) is subsequently made, the assessment of the sport rules (focusing on their kinds, way of their enacting, their meaning for meeting the standard of care) follows. The thoughts on the relation of legal rules and sport rules are presented, the scope of legitimate penetration of law into sport is argued. Title: Crisis management and the solution of a bankruptcy of a profitable sports club Objectives: The main objective of this thesis is to propose general procedures of profitable sports clubs dealing with crisis and bankruptcy. Methods: This thesis is based on a qualitative research. Documents related to insolvency were analyzed, specifically act No. 182/2006 Coll., The Act of Bankruptcy and Ways of its Resolution (The Insolvency Act), as amended by subsequent regulations and publicly accessible insolvency proceedings in the insolvency register. Qualitative interviews with insolvency law specialists have been executed using the manual to make sure the thesis results are objective. Results: A general manual for entrepreneurs in profitable sports facilities was compiled by the analysis of necessary documents and based on the The Insolvency Act. The manual serves for times when a sports facility gets into financial problems resulting in insolvency proceedings. In some cases, an insolvency proposition has to be submitted, with regard to a potential responsibility of the statuary authorities or people in charge of financial obligations. Title: Establishment of a Non-Profit Organization Providing Sports Activities with Focus on Law and Organizational Structure Targets: The target of the work is to create a guide describing how to proceed with establishment of a non-profit organization providing sport activities from the legal point of view. Another target of the work is a creation or determination of an organizational structure for sport oriented non-profit organization with a membership of up to 100 members. Methods of research: The following methods were used to create a business plan: literature research, document analysis, semi-structured interview with an attorney-at- law relating to issues of establishment of a non-profit organization, semi-structured interview with a bookkeeper of AK Zlín relating to non-profit organization financing and tax issues. Results: The result of the work is a guide describing particular steps of a process relating to establishment of a non-profit organization. The guide includes necessary documentation for establishment of a sport club as a registered association.
