Problematika zadávání veřejných zakázek malého rozsahu

Tato diplomová práce se zabývá problematikou zadávání veřejných zakázek malého rozsahu a to se zaměřením na problémy, se kterými se musí potýkat zadavatelé 42. mechanizovaného praporu při zadávání veřejných zakázek malého rozsahu prostřednictvím elektronického tržiště Tendermarket a s problémy, které jsou spojeny s výběrem vhodného dodavatele. V teoretické části se seznámíme s pojmem veřejná zakázka malého rozsahu, jejím členěním a zmapujeme právní předpisy a nejdůležitější interní normativní akty (dále jen INA), které zkoumanou problematiku upravují v resortu MO ČR. Analytická část bude zaměřená na samotné problémy, se kterými se zadavatelé potýkají při zadávání a vyhodnocování veřejných zakázek malého rozsahu. Na jedné zakázce malého rozsahu bude vysvětlen postup zadávání zakázky v elektronickém tržišti Tendermarket. Následně budou vyhodnoceny problémy či nedostatky, které při tomto zadávání a vyhodnocení vznikly.

Resolving of insolvency of business corporations trough bankruptcy

The presented thesis tries to introduce the reader to the course of the insolvency proceedings, especially in bankruptcy proceedings. The theoretical part mainly discussed about the meaning and history of this institute, further aspects necessary for the commencement of insolvency proceedings and then there is described in more concise form the additional course up to the decision on the debtors bankruptcy. Subsequently, the author deals with the consequent procedure in cases where the debtors bankruptcy is solved by bankruptcy. Describes the course, focusing primarily on the sale of the debtors property and its subsequent allocation among the creditors until its conclusion, which is the submission of the final report by the insolvency administrator of the court, its subsequent approval and distribution schedule. In the practical part of the thesis the theoretical knowledge mentioned above is applied to the selected insolvency case of business corporation. In this part there are also pointed some potential problems and complexities that arose in this case. There is also described and analyzed the entire insolvency proceedings from filing an insolvency petition to the preparation of the final report by the insolvency administrator, that is the stage where the proceedings took place on the date of submission of this work. Furthermore, the author discusses the development and the number of insolvency proceedings in our country since 2008 when the new legislation of this institute came into force. On the same principle, the author also deals with the analysis of the most common types of obligations of business corporations.

Administration of public procurement

The thesis is focused on proposing changes in methodological procedures relating to the public tendering administration in the selected institution and consequently also changes in the relevant legislation, especially in the terms of principles, which a public tendering authority must implement under the Act no. 137/2006, on public tendering. The work contains a theoretical and practical summarization of legal steps according the current legislation and a proposal of changes in the form of amendment of the public tendering act. Since dealing with this issue for many years, it was my attempt to incorporate my own practical experience and knowledge into the proposal of these changes. The thesis is divided into three thematic parts. In the first part there is an introduction of a summary of basic rules and procedures in public tendering since 1990 till present, i.e. the act no. 137/2006, on public tendering. The second part focuses on a practical example of the public tendering procedure. The third part contains the proposal of changes in rules and procedures leading to the promotion of equal treatment, transparency and non-discrimination in public tendering, as well as of their practical application.

Procedural aspects of civil procedure

The main theme of this thesis is the issue of the procedural acts of judicial proceedings (focused mainly on aspects of delays), in the code of civil procedure as part of the legal order of the Czech Republic.
The theoretical part defines the procedural aspects of civil procedure. The main focus is on the delay of court proceedings on the part of the participant and subsequently the defence against delays in the proceedings caused by the court. The thesis contains the statutory documents of the legal order of the Czech Republic. The essential part of the theoretical thesis is the rights for the protection of citizens' rights, which are embedded in the Charter of Fundamental Rights and Freedoms and in the European Convention for the Protection of Human Rights and Freedoms. In this section main sources of information were the Code of Civil Procedure, the Civil Code, the Charter of Fundamental Rights and Freedoms and other laws that are closely related.
The practical part of this thesis is focused on the issue of the frequency of court proceedings in the divorce rate and, consequently, on the amount of agenda of the court, statistically maintained by the executor of the judicial process, in this case by the District Court of Kolín (i.e.court of first instance). Statistics of divorces involve the years 2012, 2013, 2014 and 2015. There are even specific cases from judicial practice.

The issue of public procurement financed by means of subsidies provided by the European Union

The thesis deals with the issue of public procurement financed by means of subsidies provided by the European Union. Its theoretical part concerns with public procurement co-financed from EU budget. This first part of my thesis focuses generally on explanation of basis terms concerning public procurement. Moreover, it outlines our national and European legislation and methods interfering in the process of public procurement co-financed from the EU budget. The thesis presents oversight bodies emphasizing the function of the Audit Authority. It pays attention to structural funds during the 2007-2013 programming period focusing on the Regional Operational Programme (ROP) North-West. The practical part concentrates on analysis and records of the most frequent mistakes in public procurement within the ROP North-West by means of analysing a sample of cases identified by the Audit Authority. The thesis uses the outputs in the form of a summary of most frequent mistakes in public procurement of the selected operational programme as the foundation for formulation of measures and suggestions for elimination of mistakes in public procurement and for recommendations on amelioration and efficiency improvement of the public procurement system.

The purpose and the function of Archives and Records Service in the state administration. The effect of documents storage on the national economy.

This thesis is about Record Services in the state administration. In the theoretical
part I mention the legislation relating with the Archive and Record Services. Then there are
described various phases of the cycle of documents. In this thesis are presented possible
forms of Record Services and also determined which entities are obliged to keep Record
Services and if so, in what form. In the theoretical part I also mention the National Archive
and National Digital Archive. In the practical part is the graphical view of the evolution of
the state expenditures on the National Archive. Then there is a short cross-section of the
amendments of Act no. 499/2004 Coll., about Archiving and Record Services and
amending certain laws and there are listed the most frequent mistakes which are made in
the performance of Record Services. In the last part of this thesis are illustrated the graphs,
that shows, how many files annually establish some state authorities and explained what
could have caused potential increase or decrease.

Legal preconditions of the market economy

The work describes and examines market economy and all legal forms of doing business in the Czech Republic in terms of suitability to set up a business. At first the market economy is defined and legal forms of business are described afterwards. There is also a comparison with other market environments. The market economy system in Germany has been chosen for these purposes. It follows from this comparison that although the German legal system offers other forms of business, which may seem more advantageous in some terms, Germany does not represent an offer attractive enough for businessman to decide for the German market instead of the Czech one. In the work, there is also a brief description of the conditions in European tax havens, which may be much more interesting for businessman.
The practical part of the work was carried out in a form of sociological research using questionnaires as the main tool. It focuses on the Czech businessmen´s views of the business conditions and environment in the Czech Republic. The research showed that the businessmen consider the business conditions in the Czech Republic to be relatively favourable, legally well-based and intelligible at the same time.

Unemployment in the Czech Republic

Bachelor Thesis Unemployment in the Czech Republic is divided into two parts, theoretical and practical. Focus of theoretical part is delimination of basic economical terms and processing of the data gatherd from the Czech Statistical Bureau and the Ministry of Labour and Social Affairs.
In practical part of thesis are analyzed and subsequently compared towns of concern, which are Prague, Brno and Ostrava. In terms of evaluation of the questionnaire are set specific hypotheses and examined their validity.
Focus of our research is to find answer for the questions What are the origins of unemployment in the Czech Republic? Which sphere of occupation is the most sought after? And if unemployed people utilize help from employment department in their search of the job?

The budget of municipality from an economics and legal point of view

The purpose of this bachelor thesis is to incurred determine the effectiveness of the management of the municipality and analyzed in 2013, 2014 and 2015 revenue and expenditure village of Malé Přítočno. Whether deficits or surpluses incurred, so to determine their causes and find suitable solution, for the community to increase budget revenues, plans to propose the creation of a budget and also using grants for 2016. In the theoretical part is used the definition of terminology regarding to local government. In the practical part that was first described by demographics and geography of the village. By comparing the budgets in individual years, it was found that the economy was effective and its budget in the years 2013 - 2015 always in surplus. Furthermore, it was found that that the municipality could apply for a grant for the wastewater treatment plan according to the Operational Programme Environment, which would give a subsidy from the Cohesion Fund in the amount of up to 85 percent (ie. 27.2 million CZK). The remaining 15 percent (ie. 4.8 million CZK) would have to cover municipality from its budget, but this is not possible, since on the account only has the amount of 2.2 million CZK. Therefor was made a suggestion to increase the revenue of the village by renting the municipal hall.

Social exclusion and its economic and legal aspects
Summary
The aim of this paper work was to evaluate the application of the laws concerning the impal of social exclusion of children and teenagers from special locations. The next drift was to map out the influence of the center Štěpán Trochta on one group of socially excluded children and teenagers from the housing quartem in Teplice Prosetice, which is known for high criminality of teenagers and big concentration of socially deprived people. The target was also to find out if it helps children to easily incorporate to school attendance, to get over difficulties and disadvantage caused by the background they live in.
Qualitative research as well as structured and half structured dialogue, observation and examination of documents was applied to this paper work. Analyzing all the facts led to summarize the results and their evaluation.
Social exclusion is a phenomena we pay more and more attention the last few years. The main priority is to solve the situation of children and teenagers who are socially excluded. If we don´t help them to improve their situation and we don´t influence thein behavior for future, they will automatically behave as their own parents and they will never extricate from the life in excluded environment. Otherwise these locations won´t be disolved, on the citrany there will be more of them. One of the possible solution is the establishment of new low cost centers and free time centers with connection of targeted complex assistance for families living in social excluded places. The research part of this paperwork mapped out the activities and the impal of these activities on inclusion of children and teenagers into every day life.
