Resumé Das Ziel dieser Diplomarbeit war die Zusammenfassung der bestehenden Rechtsregelung von dem Tarifvertrag und zugleich die Entwicklung der Rechtsregelung von den Tarifverträgen. Ich habe gleichzeitig auf die bestehende Rechtsregelung des Tarifvertrags hingewiesen, wie diese Regelung in der Bundesrepublik Deutschland geregelt ist. In den ersten Teil meiner Arbeit habe ich mich mit der historischen Entwicklung von dem Kollektivarbeitsrecht zu der Analyse der bestehenden Rechtsregelung befasst. Der nächste Punkt war die Verankerung des Kollektivarbeitsrechts in der tschechischen Rechtsordnung, die von dem europäischen Recht und von den internationalen Verträgen, durch die die Tschechische Republik in diesem Gebiet gebunden ist, beeinflusst wird. Ich habe mich weiter mit dem einsamen Begriff von dem Tarifvertrag und mit den Begriffen befasst, die mit den Tarifvertrag zusammenhängen. Es geht vor allem über die Begriffe wie die Subjekte von den Tarifverträgen, was der Inhalt von Tarifvertrag sein kann, welche die gesetzliche Voraussetzungen für die Gültigkeit und Wirksamkeit des Tarifvertrags sind, die Speicherung des Tarifvertrags und die Bekanntmachung mit dem Inhalt der geschlossenen Tarifverträge. Equal treatment and prohibited discrimination against employees

Resumé Equal treatment and non-discrimination are rules that are essential in international law, European law and national law. They are regulated in many international documents, in terms of European law, especially, in the regulations and directives. Czech Republic, as one of the member States of the European Union is obliged to ensure compliance of national law with European law. It was therefore necessary in order to ensure compliance with requirements of the EC / EU in the field of equal treatment and non-discrimination of employees that are regulated in anti-discrimination directives with our national law. This happened by adoption of Act No. 198/2009 Coll., Anti-Discrimination Act, which as a general law governing these principles. In my works I deal with treatment of these principles in the documents of international law and international organizations active in this area in the primary and secondary law of the EC/EU and also the current modification in our legal system. My work is divided into an introduction, six sections and a conclusion. The methods of terminating employment Abstract This diploma thesis primarily purports to describe and summarize individual methods of terminating employment in the Czech Republic with an emphasis on legal acts leading to and resulting in employment termination. As a result, this thesis includes applicable case law of the Czech Supreme Court. I further focused on recently adopted Act No. 365/2011 Coll., which amends the Labour Code, and the resulting changes impacting the area of employment termination. The primary sources I applied to this thesis include Act No. 262/2006 Coll. the Labour Code, applicable rulings (case law) by the Czech Supreme Court, and specialized literature, including articles in legal magazines. This diploma thesis consists of three main chapters. The first chapter is a glossary of basic terms and expressions relative to employment termination. The second chapter is the key chapter and deals with legal acts to be taken to terminate employment. The first section of the first chapter describes an employment termination agreement, including the related requirements and a review of applicable law. - 67 - Abstract: The purpose of the thesis is to evaluate the current situation in the Czech republic in regards to employment of foreigners, analyze the process of obtaining employment permit. Analyzing the situation in respect to nationals of European union countries, nationals from "third states" and other nationals that do not need such permit. Describing the process from the employer's standpoint, applicants and the authorities in this field. The thesis is therefore divided into five parts. Commencing with introduction to the current employment situation in the Czech working market, introducing the various factors that are shaping the working market globally and brief historical background of working market and migration in the Czech republic. I further describe the jurisdiction governing the employment of foreigners ie. EU nationals as well as nationals from the third countries and the various terminology used in this area of law. Welfare of women during pregnancy and maternity

Analysis and evaluation of positive law of benefits which are drawn by people in the Czech republic was my main intention. The result of frequent amendments is questionable interpretation of particular provisions and decline of legal certainty, because neither instructed employees who work in employment offices or in others can help general public. In the Czech republic there is a stronge social-democratic feeling from interwar period that is receding from the reality of our lives. Quick economic changes during 90'caused admission of liberal measures. These consequences carried into effect, that Czecch family policy of the begining of this millenium is a combination of various wals, very difficult to be classify. On the one hand I see a problem in current concepts of role of the family by young people because it devaluates gradually which you can notice in a big amount of divorces, fall of marriages, in a way to postpone pragnancy, drop of new-born babies etc. On the other hand it is necessary to say, that in fact, there is still distrust in a case to employ mothers of small children and that's why i tis very difficult to join both, care about family and building of career.
