Employing foreigners in the territory of the Czech Republic

This thesis is devoted to issues of employment of foreigners in the Czech Republic. In the thesis considered the historical reasons of labor migration in the European context, as well as in the Czech Republic. The main objective of thesis is to determine the basis of legal mechanisms of regulation of employment of foreign workers. In the practical part of the thesis analyzed the effect of employment of foreign labor in the social and economic indicators of the economy. In the final part presented an assessments of the existing legislative framework, as well as recommendations for possible changes.
The system of the social support in the Czech Republic - purpose and development

This theses deals with the subject area of social support. In twelve chapters, seeks a comprehensive approach to the problems associated with the Act no. 117/1995 Coll., On state social support, as amended, together with other relevant legislation. Thirteenth chapter shows differences in selected models of social policy that creates the conditions for social trends and priorities of social assistance in the state. The aim of this study was to analyze the wide variety of subject state social support, while trying to find an appropriate way related sources which illustrate the deeper meaning of this institute. Through analysis of relevant documents has been the formation of a complex form of comments on the law on state social support in the form, which is still legal in the scientific community are missing. Employment of persons with a health handicap

The aim of this thesis is to describe the key issues of employment of persons with disabilities as they are one of the most endangered category of employees and their protection in the scope of the legal regulation. The thesis is systematically divided into five chapters, each of them dealing with different aspects of the topic. Chapter one is introductory and defines basic terminology. This chapter is subdivided into three parts. Part one analyses the historical development of the approach of the majority society to the people with disabilities and focuses primarily on the medical and social model of disability. Part two deals with the definition of the persons with disabilities as defined in the international and European law. Part three further addresses the issue of this definition in Czech law. Chapter two provides an outline of relevant international sources as well as the sources of the European Union. It mentions the main documents of International Labour Organization, United Nations, Council of Europe and also the essential documents of European Union. Social welfare of families with children

For circumstances of need, people are secured be three systems, i.e. by social insurance, state social support and social assistance. Through the state social support the state contributes mainly to families with dependent children who are faced with a recognized social situation that the family is unable to cope with via its own efforts and means. The system applies the solidarity principle between high-income families and lowincome families, as well as between childless families and those with children. The system of the state social support was established in 1995 and is regulated by Act No 117/1995 Coll. on State Social Support, as amended. The state social support is a noncontributory system financed from the state budget. The system is applied in cases, where family's own financial means are deemed insufficient to maintain a basic standard of living. State social support benefits are currently the main form of financial support for families with children in various difficult social situations. The system is based on income testing, there is no means test. A person is entitled to receive benefits if he or she and other people living in a common household have permanent residency in the Czech Republic. Contractual freedom and its limitation in the formation, changes and termination of the employment relationship

This thesis is focused on a contractual freedom in employment relations, especially upon formation, changes and termination of the employment relationship. The contractual freedom is the key principle of private law, therefore also of labor law, and the expression of the contractual freedom is the freedom of an individual in his choice whether to enter into an employment relationship, who to enter with, what content would the employment relationship have and when and how to terminate this relationship. The contractual freedom upon formation, changes and termination of an employment relationship is necessary to be limited due to protection, safety and certainty of employees and also in the public interest. One of the objectives of this thesis is to think about how should be this restriction of the contractual freedom limited. In this work there is also a description of a historical development of a regulatory autonomy of the will of the parties and a description of a statutory regulation of the formation, changes and termination of an employment relationship. Non-competition clause

The aim of my thesis is to explain the meaning of the expression "non- competition clause" and to analyse its legal regulation in Czech labour law. The reason why I chose this topic is that non-competition clause is a very dynamic subject with a lot of changes in a historical point of view as you can see above. First of all, non-competition clause is an instrument of labour law which protects an employer against the abuse of the company's confidential information, knowledge and other know-how by the employee. According to the Czech legislation, non- competition clause means a voluntary agreement between employer and employee whose purpose is to protect employer's interests by reducing employee's job opportunities which would have a competitive character to the employer after the determination of an employment with the employee. There are several conditions need to be achieved in order to conclude a valid non- competition clause. For example, this contract needs to be agreed in writing. Secondly, the non-competition clause may be valid for only a certain period of time, not exceeding one year. Moreover, an employer is obliged to pay the employee some kind of a financial compensation every month.
