Copyright protection in the musical industry The puropse of my thesis is to analyse the musical work in context of the main source of the Czech copyright protection and with the inclusion of the protective instruments. The reason for my research is coming closer to the legal rules of musical work's application, thereby avoiding the unlawful use. First of all I pay attention to the basic information about the copyright and the musical work . At the digital age, due the technology development, is everyone able to use all these facilities, and there is no different in the musical industry. Authors, performers and recording companies, each of them is loosing every year their profits thank to the illegal use. There is no surprise they are inetersted in new facilities in the copyright protection and they are supporting the operating system. The thesis consists of night chapters, each of them is dealing with different aspects of the musical work. First introductory chapter defines what the intellectual property and copyright protection is, which matter of copyright is protected, including the Czech system of the copyright. 80 Abstract The aim of this thesis is to describe various ways of use of works on the Internet and method of their copyright protection in this specific environment. Because without any doubt the Internet interferes with everyday life of today's society and subsequently has a significant effect on further development of a legal system, this topic becomes very relevant. The thesis itself is divided into four chapters. The first chapter is devoted to general description of the Internet and copyright law, and contains explanation of development of this private law area in the territory of the independent Czech Republic, including list of national and international legal sources. The second chapter defines the copyrighted work and its different types according to the Czech Copyright Act, an individual author, use of the work, whether in the form of a contractual or non-contractual disclosure and also important topic of making the work available through the Internet. The third chapter analyzes the copyright protection in the private and public spheres, and technical means of such protection (DRM). Unlawful use of a copyrighted work

This thesis is focused on the theme of unlawful use of a copyrighted work. The main aim of this work is to provide a fundamental insight into the current state of protection of rights belonging to the authors in the Czech Republic, emphasizing the exclusive right of exploitation. Furthermore by using the examples of selected forms of exploitation this thesis aims to delineate a certain line between a lawful and unlawful use of a copyrighted work, especially with regard to the case law of the CJEU. This thesis is composed of four chapters, which are divided into sections and subsections. Chapter One is an introductory chapter which provides definition of a copyrighted work and explains the content of exclusive rights of authors to their works. Chapter Two focuses on the right of exploitation. It describes various forms of exploitation of copyrighted works and also deals with the regulation of a license agreement and the non-contractual use of works secured by the exceptions and limitations of copyright. The legislative changes caused by the recodification of Czech civil legislation are also reflected. A comparison of copyright protection of authors and performing artists The aim of this thesis is to compare the legal regulation of the authors' rights in their works and the performing artists' rights in their performances as it arises from the Czech Copyright Act. I have chosen this topic because it requires profound study of the Copyright Act, good understanding of most of its provisions and their analysis. In my opinion, this kind of research could be very useful in my upcoming profession. Besides it seems to be quiet an actual theme, as for example the term of protection of these rights is largely discussed of late. The structure of this paper is following. The first three chapters are introducing the main characteristics of the authors' and performing artists' rights, their development and the main sources. Other chapters are dealing with the comparison of the protection itself. I examine the aspects I consider to be crucial. It is the subject of the rights, the object, moral and economic rights, the criterions of the protection, the contractual and non-contractual obligations and the term of protection.
