Competition policy of the Czech Republic in the field of state aid

The efficient competition protection is EU's crucial key objective in order to provide smooth functioning of the local competition and the internal market. Within different segments of the competition I focused on the state aid issue, which is a specific area of the EU competition law. Providing any state aid inevitably influences the market enviroment and carries a considerable risk of the competition distortion. It effects the trade between Member States as well. The main aim of this diploma thesis is not only to describe the European legislation related to state aids, but also its impact on the Czech legal system. The Community state aid rules stem from Articles 107 - 109 of the Treaty on the Functioning of the European Union and their main purpose is to prevent any selective advantages to certain market players. This thesis also focuses on reforms and modernization of the state aid control system, in particular to the State Aid Action Plan.
THE LATEST TRENDS IN PUBLIC PROCUREMENT LAW

This thesis deals with public procurement law in the Czech Republic. It captures the latest trends in public procurement law, together with the amendment to the Public Procurement Act, which entered into force on 1 April 2012. The opening chapter introduces the concepts that are closely related to the issue of public procurement and corruption. There are explained key institutional control mechanisms in the Czech Republic and criminal liability of corruption. The analytical part of this thesis describes the changes, which the amendment brought into the Public Procurement Law. These changes are mainly assessed in terms of impact on the suppression of corruption. This thesis presents and analyzes the arguments of proponents and opponents of the amendment. The analysis is accompanied by a brief look at the development of legislation on public procurement in the European Union in general and in two selected countries of the European Union. The conclusion contains a summary assessment of the issue along with an outlook for a possible further developments in the legal regulation of public procurement. Based on the analysis, the thesis leads to the conclusion that the amendment of public contracts, despite some shortcomings, is leading to a more transparent procurement environment.
A comparison of legal regulation of the cadastral in Czech republik and Russian federation

The aim of the thesis is to describe the real estate legislation in selected areas and to summarize the differences between the legal real estate in the Czech Republic and the Russian Federation. This theme was chosen in order to highlight the diversity of real estate legal institutions in both countries. A common feature of the legislation in both countries is that their skills are performed in a professional manner in accordance with applicable standards and regulations of the country. The thesis is divided into six chapters. The first chapter deals with the characteristics of real estate in the Czech Republic. The main resource of law in this field is the Law No. 344/1992 Coll. Cadastre. The second chapter deals with the characteristics of real estate in Russia. The third chapter discusses the changes which currently rules the Land of the Russian Federation passed. The old provisions of the Act are replaced by more modern and the law generally becomes easier. A special feature of the Russian legislation, the institute cadastral engineer, which is entirely devoted in the fourth chapter. The fifth chapter describes the specific differences in the area of real estate law in both countries, and the last sixth chapter deals with the future developments in this area of law in both countries
The Law on Public Procurement and Procurement Experience in the Czech Republic

The subject of this thesis focuses on Public Procurement, precisely on the structure of legal regulations. This thesis broaches certain issues of the law, imperfections in the law and how the law is interpreted in practice. The aim is to understand the deeper issues of these legal regulations. The backbone of this legal regulation is the law 137/2006 Coll. on public procurement. This law is one of the preventive legal standards; among other purposes it prevents wastage of public funds. However, ensuring flawless application of The Act is not as easy a task as it would seem at first sight and the second part of this thesis is therefore devoted to identifying the most common errors in application of this law. Decisions of the Office for Protection of Competition, consultations with experts, and case studies were used for identification of these errors and common types of misconduct are also presented. The conclusion will deal with the amendment to the Public Procurement Act.
Analysis of the effectiveness of public- private partnership

The theme of thesis is to analyze the effectviveness of public- private partnership. The thesis consists of theoretical and practical parts. The theoretical part defines public goods and means of their security. The following defines the public-private partnership. Than there is the evaluation of public procurements and Public Private Partnership projects in a legal and financial aspects. The practical part describes legal security and financing of Public Private Partnership project Aquapark Olomouc along with SWOT analysis and risk analysis. The analysis above leads to the identification of problematic points of the project. Finally, suggestions are formulated to solution of identified problems and evaluate whether, in this particular case, public-private partnership has been effective.
Public Procurement of Local Selfgovernment

This graduation thesis "Public Procurement of Local Selfgovernment" describes the problems of public procurement. The core subject is the difficulty to observe the law on public procurement. This work includes a case study that mainly evaluates the process of a specific public procurement carried out by a local selfgovernment and the method used to appraise the bids. In order to obtain further information on public procurement at the municipal level, the paper includes a survey addressed to the public administration. The work concludes with a SWOT analysis on public procurement.
