Právní význam poradních stanovisek mezinárodních soudů v oblasti ochrany klimatu Abstrakt Předkládaná diplomová práce analyzuje právní význam poradních stanovisek Mezinárodního soudního dvora (červenec 2025), Meziamerického soudu pro lidská práva (květen 2025) a Mezinárodního tribunálu pro mořské právo (květen 2024) v kontextu ochrany klimatu. Tato poradní stanoviska se stávají klíčovým nástrojem pro vyjasnění klimatických povinností států v situaci, kdy je reakce mezinárodního společenství neadekvátní a relevantní právní úprava roztříštěná. Hlavním cílem práce je identifikovat interpretativní relevanci, normativní potenciál a praktické právní důsledky těchto aktů. S využitím analýzy pramenů mezinárodního práva a komparativní metody práce potvrdila hypotézu, že zkoumaná klimatická poradní stanoviska mají silný potenciál formovat mezinárodní právo, ačkoliv jsou formálně nezávazná. Jejich reálná efektivita je však podmíněna následnou akceptací ze strany suverénních států. V praktické rovině práce zkoumá vliv klimatických poradních stanovisek ve třech oblastech. V klimatických litigacích se jejich závěry již aktivně využívají nejen u vnitrostátních soudů. V mezinárodní diplomacii jsou výsledky smíšené. Významným úspěchem je reflexe stanovisek v rezoluci Valného shromáždění OSN, obecná vyjednávání však vykazují... 1 The Legal Significance of Advisory Opinions of International Courts in the Field of Climate Protection Abstract This master's thesis analyzes the legal significance of the advisory opinions of the International Court of Justice (July 2025), the Inter-American Court of Human Rights (May 2025), and the International Tribunal for the Law of the Sea (May 2024) in the context of climate protection. These advisory opinions are becoming a key instrument for clarifying the climate - related obligations of states in a situation where the international community's response is inadequate and the relevant legal framework is fragmented. The main objective of the thesis is to identify the interpretative relevance, normative potential, and practical legal consequences of these acts. Using an analysis of the sources of international law and a comparative method, the thesis confirms the hypothesis that the examined climate advisory opinions have strong potential to shape international law, despite being formally non-binding. However, their real effectiveness is conditioned upon subsequent acceptance by sovereign states. On a practical level, the thesis examines the impact of these advisory opinions in three areas.
