Abstrakt, klíčová slova Právní a praktické aspekty využívání telekomunikačních odposlechů z pohledu policejního orgánu Tato rigorózní práce se věnuje právním i praktickým aspektům využívání telekomunikačních odposlechů v trestním řízení z perspektivy policejního orgánu. Volba tématu vychází z profesní zkušenosti autorky, která se s tímto institutem pravidelně setkává v rámci své praxe. První část se zaměřuje na ústavní rámec zásahů do soukromí, zejména na zásadu zákonnosti, proporcionality a ochrany osobních práv. Pozornost je věnována také mezinárodním závazkům, jimiž je Česká republika v této oblasti vázána. Druhá kapitola analyzuje vnitrostátní právní úpravu telekomunikačních i prostorových odposlechů. Podrobně rozebírá podmínky jejich povolení, náležitosti návrhu a příkazu, postup při realizaci a pravidla pro nakládání se získanými záznamy. Stěžejní třetí kapitola se soustředí na praktické problémy spojené s jejich aplikací. Zabývá se technickým a personálním zabezpečením, proměňujícími se komunikačními návyky pachatelů i vlivem medializace trestních kauz, která může ovlivnit průběh řízení i chování obviněných. Není opomenuta ani otázka nezákonného pořízení záznamů, procesním pochybením a jejich dopadům na použitelnost důkazů, včetně zásahů do důvěrné komunikace mezi advokátem a klientem. Čtvrtá... Abstract, keywords Legal and practical aspects of the use of telecommunications interception from the perspective of law enforcement agencies This dissertation examines the legal and practical aspects of the use of telecommunications wiretaps in criminal proceedings from the perspective of a law enforcement agency. The choice of topic stems from the author's professional experience, as she regularly encounters this practice in her work. The first part focuses on the constitutional framework governing intrusions into privacy, particularly the principles of legality, proportionality, and the protection of personal rights. Attention is also given to the international obligations to which the Czech Republic is bound in this area. The second chapter analyzes domestic legislation on telecommunications and room surveillance. It examines in detail the conditions for their authorization, the requirements for the proposal and the order, the procedure for implementation, and the rules for handling the obtained records. The pivotal third chapter focuses on practical problems associated with their application. It addresses technical and personnel security, the changing communication habits of offenders, and the impact of media coverage of criminal cases, which can influence the course of proceedings and the behavior of...
