[cze][eng] Práce se zabývá transformací dobrovolných svazků obcí na společenství obcí, jejichž institut byl zaveden novelou zákona č. 128/2000 Sb. s účinností od 1. ledna 2024. Cílem práce je zachytit průběh tohoto přechodu, identifikovat motivační a bariérové faktory transformace a posoudit roli státu v tomto procesu. Hlavní metodou sběru dat byly polostrukturované rozhovory doplněné obsahovou analýzou dokumentů. Empirická část vychází z komparace dvou případů: Společenství obcí ORP Příbram a Jilemnicko-společenství obcí, reprezentujících strukturálně odlišné modely transformace. Analýza identifikovala dva modely vzniku: kontinuitní, při zachování právní kontinuity svazku, a paralelní, kdy nové společenství vzniklo vedle původního svazku z majetkových a daňových důvodů. Hlavním zjištěním je klíčová role manažera jako nositele důvěry a hlavní systémovou slabinou zůstává nestabilní financování závislé na každoročních dotačních titulech.This thesis examines the transformation of voluntary associations of municipalities into communities of municipalities, a legal institution established by an amendment to Act No. 128/2000 Sb., effective as of January 1, 2024. The aim of this thesis is to document the course of this transition, identify the motivating and hindering factors of the transformation, and assess the role of the state in this process. The main method of data collection was semi- structured interviews supplemented by content analysis of documents. The empirical section is based on a comparison of two cases: Společenství obcí ORP Příbram and the Jilemnicko- společenství obcí, representing structurally different models of transformation. The analysis identified two models of formation: the continuous model, which maintains the legal continuity of the association, and the parallel model, in which a new association was established alongside the original association for property and tax reasons. The main finding is the key role of the manager as a trusted figure, while the main systemic weakness remains unstable financing dependent on annual grant allocations.
