Prohlášení viny v systému konsensuálních způsobů řešení trestních věcí Abstrakt Diplomová práce se zabývá institutem prohlášení viny podle § 206c trestního řádu, který byl do českého právního řádu zaveden novelou č. 333/2020 Sb. a představuje významný projev posilování konsensuálních prvků v trestním řízení. Cílem práce je vymezit systematické postavení tohoto institutu v rámci konsensuálních způsobů řešení trestních věcí a posoudit, do jaké míry přispívá k efektivitě trestního procesu při současném zachování zásad spravedlivého procesu. Zvláštní pozornost je věnována jeho vztahu k dohodě o vině a trestu a k institutu nesporných skutečností, stejně jako otázce rozsahu dispoziční autonomie obžalovaného. Práce je založena na analýze právní úpravy, odborné literatury a relevantní judikatury, doplněné o komparativní přístup. Na základě provedené analýzy je dovozeno, že institut prohlášení viny zaujímá specifické mezistupňové postavení mezi dohodou o vině a trestu a institutem nesporných skutečností. Přispívá k efektivitě trestního řízení zejména omezením rozsahu dokazování a koncentrací řízení na rozhodnutí o trestu, jeho přínos je však podmíněn důsledným zachováním procesních záruk, zejména dobrovolnosti a informovanosti projevu vůle obžalovaného, jakož i zachováním aktivní kontrolní role soudu. Admission of guilt in the system of consensual ways of processing criminal cases Abstract This diploma thesis deals with the institute of admission of guilt under Section 206c of the Czech Criminal Procedure Code, introduced into the Czech legal system by Act No. 333/2020 Coll., which represents a significant manifestation of the strengthening of consensual elements in criminal proceedings. The aim of the thesis is to define the systematic position of this institute within the framework of consensual forms of resolving criminal cases and to assess the extent to which it contributes to the efficiency of criminal proceedings while preserving the principles of a fair trial. Particular attention is paid to its relationship to plea agreements and to the institute of undisputed facts, as well as to the question of the scope of the defendant's dispositional autonomy. The thesis is based on an analysis of legislation, academic literature and relevant case law, complemented by a comparative approach. On the basis of this analysis, it is concluded that the institute of admission of guilt occupies a specific intermediate position between plea agreements and the institute of undisputed facts.
