[cze][eng] Disertační práce zabývá institutem odkazu. Vychází z historické perspektivy, která počíná už v právu římském, ale především zkoumá ustanovení ABGB, a hledá odpověď na otázku, do jaké míry jsou ustanovení ABGB a vládního návrhu z r. 1937 shodná s platnou právní úpravou odkazu v Občanským zákoníku z roku 2012, či se naopak liší. Historická cesta odkazu ve středověku není vakantní, naopak, v té době je právní vývoj charakterizován partikularismem, člověk si nese své právo s sebou. Tady má kořeny institut nedílu, který byl pro dědické právo signifikantní. Až posléze se rozvinulo dědění mimo nedíl, prostřednictvím pořízení pro případ smrti. Mezi pořízení pro případ smrti patřil kšaft, středověký testament, v němž zůstavitel určoval nástupce jednotlivých věcí. Ustanovení o odkazu se objevila nejdříve v právu městském (Práva městská Království Českého Markrabství Moravského od Kristiána z Koldína) a následně i v právu zemském (Vladislavské zřízení zemské, Obnoveném zřízení zemské). Zásadním kodexem pro úpravu odkazu se stal Všeobecný zákoník občanský, ABGB, z r. 1811. Tento na svou dobu moderní kodex obsahoval ucelenou úpravu odkazu. Za období účinnosti ABGB (do konce r. 1950) vznikla k odkazu početná judikatura (sbírky Glaser-Unger, Glaser-Unger Neue Folge, Vážného sbírka). ABGB se stal předlohou pro...The present dissertation delves into the institute of legacy. The dissertation is grounded in a historical perspective, which begins with Roman law, though its primary focus is to examine the provisions of the ABGB, seeking an answer to a query as to the extent to which the provisions of the ABGB and the Government Bill of 1937 correspond to the current legal regulation of legacy in the Civil Code of 2012, or, conversely, how these legal frameworks differ. The historical path of legacy in the Middle Ages is by far not vacant; on the contrary, legal development was at that time characterised by particularism, with individuals carrying their law with them. This is where the institution of the undivided estate originated as a significant concept for inheritance law. Only later did the inheritance outside the undivided estate develop, namely through dispositions mortis causa. Dispositions mortis causa included a testamentary deed (known historically as "kšaft"), a medieval testament, in which the testator appointed successors to specific items. Provisions concerning legacy first appeared in municipal law (The Municipal Law of the Kingdom of Bohemia and the Margraviate of Moravia by Kristián of Koldín) and subsequently in provincial law (The Vladislaus Provincial Ordinance, The Renewed Provincial...
