Implementace směrnic EU v pracovněprávní oblasti Abstrakt Předkládaná disertační práce se zaměřuje na analýzu implementace pracovněprávních směrnic EU v České republice. Práce se věnuje implementaci v širším slova smyslu - tedy nejen transpozici směrnic do českých právních předpisů, ale i reálné aplikovatelnosti a soudní vymahatelnosti práv, která ze směrnic vyplývají. V úvodu práce jsem si stanovila výzkumné otázky, které pokrývají předmět zkoumání. Práce je členěna na 4 kapitoly. V prvních dvou kapitolách práce ukotvuji pojmový aparát a vymezuji historická i legislativní východiska evropského pracovního práva, včetně limitů sdílené pravomoci a zásady minimální harmonizace. Na tento teoretický základ následně navazuje zkoumání důsledků, jež s sebou přináší nenáležitá či opožděná transpozice. Pozornost je zde věnována nejen riziku finančních sankcí hrozících státu v rámci řízení o porušení unijního práva, ale především možnostem jednotlivce domoci se svých nároků u soudu. Stěžejním bodem této části je rozbor judikatury SDEU, která prostřednictvím Listiny základních práv EU prolamuje zákaz přímého horizontálního účinku směrnic, čímž otevírá cestu k uplatňování práv vyplývajících ze směrnic i vůči soukromoprávním zaměstnavatelům. Implementation of EU Directives in the Field of Labour Law Abstract This thesis focuses on the analysis of the implementation of EU labour law directives in the Czech Republic. The thesis deals with implementation in a broader sense - thus, not only the formal transposition of directives into Czech legal regulations, but also the practical applicability and judicial enforceability of the rights derived from these directives. In the introduction, I set out the research questions that cover the subject of the research. The thesis is divided into four chapters. In the first two chapters, I set the conceptual framework and define the historical and legislative background of European labour law, including the limits of shared competences and the principle of minimum harmonization. This theoretical foundation is subsequently followed by an examination of the consequences brought about by improper or delayed transposition. Attention is paid here not only to the risk of financial sanctions threatening the state within infringement proceedings but primarily to the possibilities for individuals to enforce their claims in court.
