Náboženská svoboda v pracovněprávních souvislostech Abstrakt V důsledku společenských a kulturních proměn se i pracovní prostředí stává stále více rozmanitějším. Tento vývoj s sebou přirozeně přináší nové situace, teoretické i praktické otázky, s nimiž se musí právní úprava, primárně pak pracovní právo, vypořádat. Mezi takové výzvy lze rovněž řadit problematiku projevů náboženské svobody na pracovišti. Tato diplomová práce se proto zaměřuje na analýzu práv zaměstnanců ve vztahu k možnosti výkonu náboženské svobody v pracovněprávních vztazích, jakož i na postavení zaměstnavatele při jejím respektování. Pozornost je věnována také soudním rozhodnutím. Primárně je zohledněna judikatura Evropského soudu pro lidská práva a Soudního dvora Evropské unie, jelikož významným způsobem přispívá k výkladu relevantních pojmů, předestírá právní názory a argumenty k dané problematice. Výsledkem je tak komparativní a analytický pohled na limity náboženské svobody v pracovněprávních vztazích. Diplomová práce nastiňuje současnou právní úpravu vztahující se k problematice náboženské svobody. V jednotlivých kapitolách jsou vypsána konkrétní ustanovení národních i mezinárodních pramenů práva, která se náboženské svobody dotýkají. Vzhledem k tomu, že v České republice absentuje systematická právní úprava zabývající se projevy... Religious freedom in the context of labor law Abstract As a result of social and cultural changes, the working environment is becoming increasingly diverse. This development naturally brings with it new situations and questions that the legal framework, and labour law in particular, must address. One such challenge is the issue of manifestations of freedom of religion in the workplace. This thesis therefore focuses on an analysis of employees' rights in relation to the exercise of freedom of religion in labour relations, as well as on the position of the employer in respecting that freedom. Attention is also paid to judicial decision-making. In particular, the case law of the European Court of Human Rights and the Court of Justice of the European Union is taken into account, as it contributes significantly to the interpretation of relevant concepts and provides legal arguments and views on the issue in question. The result is a comparative and analytical perspective on the limits of freedom of religion in labour relations. The thesis outlines the current legal framework relevant to the issue of freedom of religion. The individual chapters identify specific provisions of legislation that relate to freedom of religion.
