Komparace kompetencí českého a německého ústavního soudu Diplomová práce s názvem Komparace kompetencí českého a německého ústavního soudu se snaží o srovnání limitů kompetencí Ústavního soudu České republiky s limity kompetencí německého Spolkového ústavního soudu prostřednictvím komparace jejich judikatury. V úvodu práce jsou v krátkosti přiblíženy všechny kompetence vyplývající českému Ústavnímu soudu z Ústavy ČR a zákona o Ústavním soudu a německému Spolkovému ústavnímu soudu ze Základního zákona a zákona o Spolkovém ústavním soudu. Vybrané kompetence obou ústavních soudů, konkrétně rozhodování o abstraktní a konkrétní kontrole norem, o ústavních stížnostech a v kompetenčních sporech, jsou poté následně vzájemně porovnány. Ve zbylé části práce jsou zvolená významná rozhodnutí Ústavního soudu České republiky v oblasti jeho vlastních kompetencí komparována s rozhodnutími Spolkového ústavního soudu v obdobných případech. Jedná se o celkem čtyři rozhodnutí Ústavního soudu České republiky, kde nebylo pro Ústavní soud snadné ze zákona dovodit, zda je příslušný k projednání návrhu či nikoliv. Rozhodnutí Ústavního soudu ČR Pl. ÚS 4/13 o přezkumu ústavnosti amnestijního rozhodnutí prezidenta republiky je porovnáváno s rozhodnutími BVerfGE 2, 213 a BVerfGE 10, 234 Spolkového ústavního soudu o přezkumu... Comparison of the competences of the Czech and German constitutional courts The diploma thesis "Comparison of the competences of the Czech and German constitutional courts" aims to compare the limits of the competences of the Constitutional Court of the Czech Republic with the limits of the competences of the German Federal Constitutional Court by comparing their case law. The introductory part of the thesis briefly outlines all the competences resulting to the Czech Constitutional Court from the Czech Constitution and the Czech Act on the Constitutional Court and to the German Federal Constitutional Court from the Grundgesetz and the German Act on the Federal Constitutional Court. The thesis then offers a comparison of the selected competences, specifically competences of both constitutional courts on abstract and concrete review of norms, on constitutional complaints and in competence disputes. In the remaining part of the thesis, selected significant decisions of the Constitutional Court of the Czech Republic in its own competences are compared with the decisions of the Federal Constitutional Court in similar cases.
