Okolnosti vzniku a doby trvání služebního poměru vojáka z povolání Abstrakt Předkládaná rigorózní práce se zabývá problematikou právní úpravy vzniku a doby trvání služebního poměru vojáka z povolání, který představuje stěžejní institut pro personální zabezpečení ozbrojených sil České republiky. Význam tohoto tématu je v současnosti akcentován zhoršenou bezpečnostní situací, v reakci na niž Ministerstvo obrany iniciovalo řadu legislativních změn bezprecedentního rozsahu s cílem navýšit počet vojáků z povolání. V souladu s platnými závazky České republiky vůči Severoatlantické alianci by totiž Armáda České republiky měla k roku 2030 čítat 30 000 vojáků. S ohledem na uvedené autor stanovil primární cíle práce analyzovat současnou úpravu de lege lata služebního poměru se zaměřením na zákonné podmínky vzniku služebního poměru a identifikaci a vyhodnocení zásadních legislativních změn realizovaných v letech 2024 a 2025, jejichž cílem bylo navýšit rekrutaci. Jelikož nedílnou součást personální stability tvoří i doba setrvání vojáků ve službě, práce se věnuje také problematice doby trvání služebního poměru vojáků, přičemž je využito komparace s ostatními služebními poměry v českém právním řádu, což ústí ve formulaci konkrétních návrhů de lege ferenda. Práce je vnitřně členěna do 7 kapitol včetně úvodu a závěru.... Conditions for the establishment and duration of the service relationship of a professional soldier Abstract Submitted thesis deals with the issue of legal regulation of the establishment and duration of service relationship, which is a key element in the personnel staffing of the Czech Armed Forces. The importance of this topic is currently emphasised by the deteriorating security situation, in response to which the Ministry of Defense has initiated a series of legislative changes of unprecedented scope with the aim of increasing the number of professional soldiers. In accordance with the Czech Republic's current commitments to the North Atlantic Alliance, the Czech Armed Forces should consist of 30,000 soldiers by 2030. With this in mind, the author set the primary objectives of the thesis to analyse the current legal regulation of service relationship, focusing on the legal conditions for the establishment of service relationship and the identification and evaluation of fundamental legislative changes implemented in 2024 and 2025 with the aim of increasing recruitment. Since the length of service of soldiers is an integral part of personnel stability, the thesis also addresses the issue of the duration of military service, using comparisons with other types of service in the Czech legal system, which...
