Institut zákonných peněz a jeho právní dopady Abstrakt Tento odborný text se věnuje institutu zákonných peněz a jeho právním dopadům v rámci české legislativy. Zákonné peníze představují základní prostředek pro vypořádání peněžních závazků a mají zásadní význam nejen pro fungování ekonomiky, ale i pro stabilitu právního systému jako celku. Práce se zaměřuje na analýzu právní povahy zákonných peněz, funkcí a postavení v jednotlivých oblastech právní regulace, zejména v soukromém a veřejném právu, a to s důrazem na jejich roli jako obecně uznávaného prostředku plnění. V rámci zpracování jsou využity platné právní předpisy, relevantní judikatura, stanoviska Ministerstva financí a České národní banky, jakož i důvodové zprávy k jednotlivým zákonům. Pozornost je věnována otázce existence a rozsahu povinnosti akceptace hotovosti jako zákonného platidla, její ochranné funkci, a současně také identifikaci výjimek a omezení, která se v právní praxi uplatňují. Text analyzuje rovněž hranice smluvní autonomie při sjednávání způsobu plnění peněžitých závazků, zejména ve vztahu k preferenci bezhotovostních plateb. Práce se dále zabývá postavením zákonných peněz ve vybraných oblastech, jako jsou pracovněprávní vztahy, veřejnoprávní odvody či platební styk, a poukazuje na rozdíly v přístupu právní úpravy. Zvláštní pozornost... 1 The Legal Tender Institute and Its Legal Implications Abstract This academic text examines the concept of legal tender and its legal implications under Czech law. Legal tender serves as the fundamental means of settling monetary obligations and is of crucial importance not only for the functioning of the economy but also for the stability of the legal system as a whole. The study focuses on analyzing the legal nature of legal tender, its functions, and its status in various areas of legal regulation, particularly in private and public law, with an emphasis on its role as a generally accepted means of payment. The study draws upon current legislation, relevant case law, opinions of the Ministry of Finance and the Czech National Bank, as well as explanatory memoranda to individual laws. Attention is given to the issue of the existence and scope of the obligation to accept cash as legal tender, its protective function, and, at the same time, the identification of exceptions and limitations applied in legal practice. The text also analyzes the limits of contractual autonomy when negotiating the method of fulfilling monetary obligations, particularly in relation to the preference for non-cash payments.
