[cze][eng] Daňová opatření členského státu jako veřejná podpora podle práva Evropské unie Abstrakt v českém jazyce Tato disertační práce se zabývá vysoce aktuální a kontroverzní problematikou aplikace pravidel veřejných podpor EU na daňová opatření členských států. Práce reaguje na trend posledních let, kdy Evropská komise začala intenzivně využívat pravidla veřejných podpor k boji proti škodlivé daňové soutěži a agresivnímu daňovému plánování nadnárodních společností, čímž fakticky nahradila harmonizaci přímých daní neexistující z důvodu absence politické shody členských států. Ústředním tématem práce je analýza rozhodovací praxe Evropské komise a judikatury Soudního dvora EU (SDEU), přičemž hlavní důraz je kladen na kritérium selektivity. Selektivita totiž představuje klíčový a zároveň nejsložitější a nejspornější definiční znak pro určení, zda určité daňové opatření členského státu představuje zakázanou veřejnou podporu. Práce detailně zkoumá vývoj a aplikaci metodologie přezkumu daňových podpor, konkrétně testů geografické a materiální (de iure a de facto) selektivity, včetně aplikace tzv. tříkrokového testu. Na základě kritické analýzy a komparace judikatury SDEU práce poukazuje na značnou nekonzistentnost a kazuistickou povahu jeho rozhodování. V rámci této analýzy se práce rovněž věnuje střetu mezi snahou...Tax Measures of a Member State as State Aid under European Union Law Abstract in English This dissertation addresses the highly topical and controversial application of EU State aid rules to tax measures of Member States. The thesis responds to the trend of recent years, in which the European Commission has increasingly relied on State aid rules as a tool to address harmful tax competition and aggressive tax planning by multinational corporations, effectively compensating for the lack of political consensus on the harmonization of direct taxation. The central focus of the thesis is an analysis of the decision-making practice of the European Commission and the case law of the Court of Justice of the European Union (CJEU), with particular emphasis placed on the criterion of selectivity. This criterion represents the key and also the most complex and contentious defining element for determining whether a tax measure qualifies as prohibited State aid. The dissertation examines in detail the evolution and application of the methodology for the assessment of tax aid, specifically the tests for geographical and material (de iure and de facto) selectivity, including the application of the so-called three-step test.
