Ochrana osobních údajů v kontextu nařízení GDPR a moderních technologií Abstrakt Diplomová práce se zabývá evropskou právní úpravou ochrany osobních údajů v kontextu moderních technologií - umělé inteligence, cloudových služeb, big data analytiky a internetu věcí - a hodnotí schopnost nařízení GDPR adekvátně reagovat na výzvy, které tyto technologie přinášejí. Práce využívá analytickou a komparativní metodu. V první části jsou představeny vybrané moderní technologie a identifikovány konkrétní aplikační problémy vznikající při jejich interakci s klíčovými zásadami a instituty GDPR, zejména zásadou minimalizace dat, omezením účelu, transparentností a automatizovaným rozhodováním dle čl. 22 GDPR. Druhá část hodnotí regulatorní přístup Evropské unie, včetně rozhodovací praxe Evropského sboru pro ochranu osobních údajů, vnitrostátních dozorových úřadů a judikatury SDEU. Samostatnou pozornost věnuje českému právnímu rámci a relevantní judikatuře českých soudů. Třetí část práce provádí komparativní analýzu vybraných regulatorních rámců ochrany osobních údajů - amerického modelu CCPA/CPRA, britského DUAA 2025, japonského APPI a čínského PIPL - a identifikuje regulatorní mechanismy a koncepční přístupy využitelné pro de lege ferenda úvahy o adaptaci GDPR. Personal Data Protection in the Context of GDPR and Modern Technologies Abstract This thesis examines the European legal framework for personal data protection in the context of modern technologies - artificial intelligence, cloud computing, big data analytics, and the Internet of Things - and assesses the capacity of the GDPR to adequately respond to the challenges these technologies present. The thesis employs analytical and comparative methodology. The first part introduces selected modern technologies and identifies specific problems arising from their interaction with the core principles and instruments of the GDPR, in particular the principles of data minimisation, purpose limitation, transparency, and automated decision-making under Article 22 GDPR. The second part evaluates the regulatory approach of the European Union, examining the practice of the European Data Protection Board, national supervisory authorities, and the case law of the Court of Justice of the European Union. Particular attention is devoted to the Czech legal framework and the relevant case law of Czech courts. The third part conducts a comparative analysis of selected personal data protection regimes - the United States model under CCPA/CPRA, the United Kingdom's DUAA 2025, the Japanese APPI, and the Chinese PIPL - and identifies...
