7 Ústavněprávní rámec udělování občanství Komparativní pohled a návrh změn s přihlédnutím k sociologicko- ekonomickým aspektům Abstrakt Práce se věnuje otázce, zda by Česká republika měla v návaznosti na ústavněprávní trendy a socio-ekonomické vlivy upravit podmínky pro udělení státního občanství, a to jak z hlediska právního rámce, tak z hlediska praktického fungování posuzovacích procesů. Teoretická část popisuje právní úpravu občanství, historické souvislosti i evropské standardy, které jsou relevantní pro posuzování žádostí. Praktická část se zaměřila na posouzení aktuální právní úpravy a na vyhodnocení toho, v jakých konkrétních oblastech by případné rozvolnění pravidel mohlo být uplatněno a jaké socio-ekonomické dopady by mohlo přinést. Z provedené analýzy vyplynulo, že současná legislativa je sice funkční, avšak v některých částech vykazuje nadměrnou rigiditu a nezohledňuje potřeby dlouhodobě integrovaných cizinců ani demografickou situaci státu. Závěr práce poukazuje na to, že případná úprava podmínek by měla probíhat postupně, s důrazem na transparentnost a efektivitu integračních procesů, aby byl zachován vyvážený poměr mezi ochranou hodnot spojených s občanstvím a potřebami moderní společnosti. KLÍČOVÁ SLOVA Česká republika, demografie, integrace, legislativa, migrace, občanství, socio-ekonomické... 7 The Constitutional Framework for Granting Citizenship A Comparative Perspective and Proposals for Change with Consideration of Socio-Economic Aspects Abstract This thesis examines whether the Czech Republic should, in light of constitutional trends and socio-economic influences, adjust the conditions for granting citizenship, both in terms of the legal framework and the practical functioning of decision-making processes. The theoretical part outlines the legal regulation of citizenship, its historical background, and the European standards relevant to the assessment of applications. The practical part focuses on an evaluation of the current legal framework and identifies specific areas in which a potential relaxation of the rules could be applied, as well as the socio-economic impacts such changes might bring. The analysis shows that although the existing legislation is generally functional, it displays excessive rigidity in certain aspects and fails to adequately reflect the needs of long-term integrated foreigners and the state's demographic situation. The conclusion argues that any modification of the conditions should be implemented gradually, with an emphasis on transparency and the effectiveness of integration processes, in order to maintain a balanced relationship between the protection of values...
