Tato rigorózní práce se zabývá problematikou ochrany životního prostředí v rámci povolování a provádění bytové výstavby v České republice. Cílem práce je analyzovat stávající legislativní rámec a posoudit, zda současná právní úprava zajišťuje dostatečnou ochranu jednotlivých složek životního prostředí při povolování a provádění stavebních záměrů v oblasti bytové výstavby. V rámci této analýzy se práce zaměřuje na nové mechanismy zavedené v oblasti povolovacích procesů, zejména na zavedení jednotného environmentálního stanoviska a přijetí nového stavebního zákona, jejichž cílem bylo zejména zrychlit a zefektivnit schvalovací procesy a zároveň zachovat vysoký standard ochrany životního prostředí. Nová právní úprava za tímto účelem přinesla klíčové změny jako je možnost obstarání jednoho stanoviska v oblasti životního prostředí nahrazujícího potřebu obstarání mnoha dílčích stanovisek a zrušení dosavadního konceptu duálního rozhodovacího procesu zahrnujícího územní rozhodnutí a stavební povolení a jeho nahrazení jediným povolením záměru. Mezi další významné změny patří také postupné zavádění prvků digitalizace příslušných řízení. Práce tak popisuje proces povolování bytové výstavby od úvodní fáze zpracování projektové dokumentace, přes změnu územního plánu, vydání rozhodnutí o povolení záměru až po vydání... This rigorous thesis deals with the issue of environmental protection in the context of permitting and construction of residential development in the Czech Republic. The aim of the thesis is to analyse the existing legislation and to assess whether the current regulatory framework ensures sufficient protection of individual environmental components in the permitting and implementation of construction projects in the field of residential development. The focus of this analysis is on the new mechanisms introduced in the area of permitting processes, in particular the introduction of the joint environmental statement and the adoption of the new Construction Act, which were aimed in particular at expediting and streamlining the approval processes while maintaining a high standard of environmental protection. To this end, the new legislation introduced key changes, such as the possibility to obtain a single statement regarding environmental protection instead of the need to obtain many statements, and the abolition of the existing concept of a dual decision-making process involving a zoning decision and a building permit and its replacement by a joint permit.
