[cze][eng] Soukromoprávní vymáhání práv k ochranné známce Cílem diplomové práce je komplexní analýza soukromoprávní ochrany práv k ochranné známce v České republice a posouzení efektivity uplatnitelných nároků v kontextu moderních technologických a ekonomických výzev. Práce se zaměřuje na stávající právní rámec, zejména Zákon č. 441/2003 Sb., o ochranných známkách a Zákon č. 221/2006 Sb., o vymáhání práv z průmyslového vlastnictví, a identifikuje klíčové slabiny v oblasti kompenzace a odpovědnosti. Zvýšená pozornost je věnována judikatuře Soudního dvora Evropské unie a Nejvyššího soudu ČR, která formuje výklad stěžejních pojmů oblasti známkového práva. Práce je metodologicky založena na historicko-právní analýze a na rozboru klíčové judikatury. Strukturálně se práce zabývá vývojem ochranné známky, charakterem soukromoprávní a veřejnoprávní odpovědnosti a podrobným rozborem uplatnitelných nároků, jako jsou zdržovací a odstraňovací nároky, náhrada škody, vydání bezdůvodného obohacení a náhrada nemajetkové újmy. Nejobsáhlejší část reflektuje aktuální výzvy spojené s umělou inteligencí (AI) a digitálními aktivy (Metaverse, NFT), kde jsou na základě případových studií formulovány návrhy de lege ferenda. Hlavním cílem práce je zodpovědět v souladu s poznatky dosaženými v jejích jednotlivých částech otázky: Jaké...Private enforcement of trademark rights The objective of this diploma thesis is to provide a comprehensive analysis of the private law protection of trademark rights in the Czech Republic and to assess the effectiveness of enforceable claims in the context of modern technological and economic challenges. The thesis focuses on the existing legal framework, specifically Act No. 441/2003 Coll., on Trademarks, and Act No. 221/2006 Coll., on the Enforcement of Industrial Property Rights, identifying key weaknesses in the areas of compensation and liability. Increased attention is paid to the case law of the Court of Justice of the European Union (CJEU) and the Supreme Court of the Czech Republic, which shapes the interpretation of the pivotal concepts in trademark law. The thesis is methodologically based on a historical-legal analysis and on the examination of key case law. Structurally, the thesis addresses the evolution of trademarks, the nature of private law and public law liability, and provides a detailed analysis of enforceable claims, such as prohibitive and removal claims, compensation for damages, unjust enrichment, and compensation for non-pecuniary harm.
