Právní aspekty ochrany volně žijících druhů ptáků Abstrakt Diplomová práce se zabývá právními aspekty ochrany volně žijících druhů ptáků v kontextu mezinárodního, unijního a českého práva. Jejím cílem je podat ucelený přehled právní úpravy na tomto poli a současně zhodnotit její praktické fungování a efektivitu. Práce je členěna na úvod, tři hlavní části odpovídající úrovním ochrany a závěr. V první části se práce věnuje mezinárodním organizacím BirdLife International a IUCN a jejich přínosu v ochraně ptactva. Dále zde představuje vybrané mezinárodní úmluvy konkrétně, Ramsarskou úmluvu, Bonnskou úmluvu, Úmluvu o biologické rozmanitosti, Bernskou úmluvu a Karpatskou úmluvu a poukazuje na jejich přínos a nedostatky. Následující část analyzuje právní úpravu ochrany ptáků v právu Evropské unie, především směrnici o ptácích, respektive směrnici o stanovištích, které tvoří komplexní systém ochrany založený na kombinaci druhové a územní ochrany, přičemž významnou roli hraje i judikatura Soudního dvora Evropské unie. Důraz je kladen i na posouzení účinnosti této právní úpravy a pozornost je věnována rovněž dílčím aspektům ochrany ptáků, jako je problematika invazních nepůvodních druhů a otrav olovem. Třetí část práce se zabývá českou právní úpravou, soustředěnou především v zákoně o ochraně přírody a krajiny.... Legal aspects of the protection of wild bird species Abstract This thesis tackles the legal aspects of the protection of wild bird species in the context of international, European Union, and Czech law. Its aim is to provide a comprehensive overview of the legal framework in this field while also assessing its practical application and effectiveness. The thesis is structured into an introduction, three main parts corresponding to the different levels of regulation, and a conclusion. The first part focuses on international organizations, namely BirdLife International and the IUCN, and their contribution to bird conservation. It also presents selected international conventions, specifically the Ramsar Convention, the Bonn Convention, the Convention on Biological Diversity, the Bern Convention, and the Carpathian Convention, highlighting both their contributions and shortcomings. The following part analyzes the legal framework for bird protection within European Union law, in particular the Birds Directive and the Habitats Directive, which together form a complex system of protection based on a combination of species and habitat conservation.
