71 Telemedicína v Evropské unii Abstrakt Tato diplomová práce se věnuje právní úpravě telemedicíny v Evropské unii a problematice přeshraničního poskytování telemedicínských služeb. Analyzuje stávající právní rámec, který je na unijní úrovni značně omezený a stanoví pouze kolizní normu pro určení rozhodného práva v případě přeshraničního poskytování telemedicínských služeb. V návaznosti na tuto analýzu práce hodnotí, zda je současná právní úprava dostačující a zda by bylo vhodné a nezbytné harmonizovat některé aspekty poskytování telemedicíny v rámci Evropské unie. Tato otázka je posuzována rovněž v kontextu nedávného judikátu SDEU ve věci C-115/24, Österreichische Zahnärztekammer, který se vůbec poprvé zabýval výkladem pravidel pro telemedicínu a překážkami, které vnitrostátní právo klade zahraničním poskytovatelům. Práce je strukturována do tří kapitol. První kapitola vymezuje pojem telemedicíny a její existující definice vycházející zejména z odborných nelegislativních dokumentů, z nichž vychází i unijní právo, které vlastní definici pro telemedicínu neobsahuje. Tato kapitola dále představuje praktické využití telemedicíny a historický vývoj jejího používání, včetně neúspěšných snah o její legislativní zakotvení. Nejprve se... 73 Telemedicine in the European Union Abstract This thesis deals with the legal regulation of telemedicine in the European Union and the issue of cross-border provision of telemedicine services. It analyses the existing legal framework, which is rather limited at the EU level and only sets out a conflict-of-law rule for determining the applicable law in the case of cross-border provision of telemedicine services. Following this analysis, the thesis assesses whether the current legal regulation is sufficient and whether it would be appropriate and necessary to harmonise certain aspects of telemedicine provision within the European Union. This issue is also assessed in the context of the recent judgement of the Court of Justice of the European Union in Case C-115/24, Österreichische Zahnärztekammer, which dealt for the first time with the interpretation of the rules on telemedicine and the obstacles that national law places on foreign providers. The thesis is structured in three chapters. The first chapter defines the concept of telemedicine and its existing definitions, based in particular on non-legislative technical documents, which also form the basis of EU law, which does not contain its own definition of telemedicine.
