Petra Ruffer Lustigová Odraz principů kolektivní bezpečnosti v judikatuře mezinárodních soudních orgánů Abstrakt v českém jazyce a klíčová slova Kolektivní bezpečnosti, tak jak je zakotvena v Chartě OSN, spočívá na všeobecném zákazu užití síly a v případě, že dojde k užití ozbrojené síly proti jednomu nebo více členským státům, rozhodne oprávněný orgán o kolektivních opatřeních. Charta OSN předpokládá, že o kolektivních opatřeních rozhodně Rada bezpečnosti, který bude mít k dispozici vojenské jednotky OSN. Zaměření práce vychází z domněnky (hypotézy), že kolektivní bezpečnost nefunguje způsobem uvedeným v Chartě OSN, a sleduje jak se s touto skutečností vyrovnává MSD ve své rozhodovací a posudkové činnosti. Zejména jakým způsobem interpretuje nejasná ustanovení Charty OSN a do jaké míry jeho judikatura následně ovlivňuje opinio juris a chování států. Hlavní výzvy, kterým MSD čelil vyplývaly z potřeby interpretovat některá ustanovení Charty OSN související s kolektivní bezpečností, a jejich vztah k paralelně platnému obyčejovému právu. MSD se zaměřil zejména na výklad některých pojmů souvisejících s užitím síly nebo hrozbou užitím síly (rozlišení přímého a nepřímého užití síly, včetně zvlášť závažného a méně závažného užití síly, pojetí územní celistvosti a politické nezávislosti); v případech sebeobrany pak... v anglickém jazyce a klíčová slova Collective security, as it is enshrined in the UN Charter, is based on the general prohibition of the use of force and on a presumption that in the event of the use of armed forces against one or more member states, an authorized organ will decide on the use of collective measures. The UN Charter stipulates that collective measures will be authorized by the Security Council, which will have UN military units at its disposal. The focus of the work assumes that collective security does not work as intended by the UN Charter and examines how the ICJ reflects on it. In particular, how the Court interprets the unclear provisions of the UN Charter and to what extent its jurisprudence subsequently influences the opinion juris and the behavior of states. The main challenges faced by the ICJ stemmed from the need to interpret some provisions of the UN Charter related to collective security and their relationship to parallelly applicable customary law.
