Kolektivní vyjednávání a mzda: Komparace kolektivních smluv v ČR, Norsku a Švédsku Abstrakt Diplomová práce se zabývá komparativní analýzou systému kolektivního vyjednávání v České republice, Norsku a Švédsku. Hlavním cílem práce je identifikovat klíčové rozdíly v právní úpravě a faktickém fungování sociálního dialogu, se zvláštním zaměřením na mechanismus odměňování a institut minimální mzdy. Práce vychází z předpokladu, že pro pochopení severského modelu je nezbytné analyzovat nejen formální prameny práva, ale především obsah kolektivních smluv vyššího stupně a tzv. základních dohod, které v Norsku a Švédsku fakticky nahrazují zákonnou regulaci. Práce využívá metodu funkční ekvivalence, kdy srovnává především severskou sektorovou úroveň vyjednávání (která stojí v hierarchii na stejné úrovni jako české kolektivní smlouvy vyššího stupně) nejen s českými kolektivními smlouvami vyššího stupně, ale i s podnikovou úrovní, neboť právě tyto roviny představují reálné těžiště vzniku mzdových nároků v daných systémech, ačkoliv nejsou stricto sensu totožnými instituty. Analýza dokazuje, že zatímco v ČR stát plní roli autoritativního regulátora, v severských zemích je především v pozici zprostředkovatele (mediátora), který poskytuje institucionální rámec pro bilaterální (samostatnou) dohodu sociálních partnerů.... Collective bargaining and wage: Comparing collective agreements in the Czech Republic, Norway and Sweden Abstract The diploma thesis deals with a comparative analysis of the system of collective bargaining in the Czech Republic, Norway and Sweden. The main objective is to identify key differences in legal regulation and the factual functioning of social dialogue with a specific focus on remuneration mechanisms and the concept of minimum wage. The thesis operates on the premise that understanding the Nordic model requires analyzing not only statutory law, but primarily the content of sectoral collective agreements and so called "basic agreements", which effectively replace statutory regulation in Norway and Sweden. The thesis employs the method of functional equivalence, comparing the Nordic sectoral level of bargaining (which stands on the same level as Czech higher-level collective agreements in the hierarchy) with not only the Czech higher-level collective agreements, but also with the company level, as these layers represent the true centres of gravity for wage formation in the respective systems, even though they are not stricto sensu identical concepts.
