Mezinárodní ochrana dospělých osob Abstrakt Disertační práce v oblasti mezinárodního práva soukromého se zabývá problematikou mezinárodní ochrany dospělých osob, které v důsledku postižení nebo nedostatečně vyvinutých schopností nedokáží v mezinárodních situacích hájit své zájmy. V kontextu stárnutí populace, nárůstu chronických onemocnění a rostoucí migrace nabývá tato otázka na stále větším významu. Základním právním rámcem zkoumané problematiky je Úmluva o mezinárodní ochraně dospělých osob z roku 2000 (dále jen "Úmluva"), přijatá na půdě Haagské konference mezinárodního práva soukromého. Úmluva upravuje otázky příslušnosti, rozhodného práva, uznávání a výkonu opatření přijatých ve smluvních státech a rovněž pravidla pro plné moci k zastupování i spolupráci mezi orgány jednotlivých států. Práce analyzuje jednotlivé prameny právní úpravy v oblasti mezinárodní ochrany dospělých osob a jejich vzájemné vztahy. Zvláštní pozornost je věnována systematice Úmluvy, jejím aplikačním problémům, vztahu k Úmluvě OSN o právech osob se zdravotním postižením a hodnocení její fungování 25 let po jejím vzniku. Blíže je analyzována i implementace Úmluvy ve smluvních státech a příklady jejího použití v nesmluvních státech. Důraz je kladen také na připravovaný návrh evropského legislativního rámce v oblasti ochrany dospělých... International Protection of Adults Abstract This dissertation in the field of private international law addresses the issue of the international protection of adults who, due to an impairment or insufficient development of their personal faculties, are unable to protect their interests in cross-border situations. In the context of population ageing, the increase in chronic illnesses, and rising international mobility, this topic is gaining increasing significance. The principal legal framework under examination is the 2000 Hague Convention on the International Protection of Adults (hereinafter "the Convention"), adopted under the auspices of the Hague Conference on Private International Law. The Convention regulates matters of jurisdiction, applicable law, recognition and enforcement of protective measures adopted in Contracting States, as well as rules on powers of representation and cooperation between national authorities. The dissertation analyses the various legal sources governing the international protection of adults and their interrelations. Particular attention is paid to the structure of the Convention, practical issues of its application, its relationship to the UN Convention on the Rights of Persons with Disabilities, and an assessment of its functioning twenty-five years after its adoption....
