Superficies solo cedit Abstrakt Diplomová práce pojednává o tématu zásady Superficies solo cedit. Tato stará právní zásada stanoví právní režim věcí nacházejících se na pozemku. Určuje, že vše, co je s pozemkem spojeno, nebo co na něm vyroste je jeho součástí. Práce se zabývá i historickým užíváním této zásady již od dob římského práva, recepci práva Rakousko-Uherského po vzniku samostatného Československého státu, přes opuštění této zásady v době socialismu a komunismu až k jejímu zpětzavedení do právního řádu České republiky s účinností od roku 2014. V úvodní části se tato diplomová práce věnuje historickému vývoji zásady superficies solo cedit, tedy jejímu zakotvení v římském právu, přes Zákon dvanácti desek, Gaiovu učebnici, kodexy Hermogeniana, Gregoriana a samozřejmě též Junstiniana. Poté pojednává o jejím zakotvení od roku 1811 v ABGB. Rozebírá také uplatňování opačné zásady Superficies solo non cedit v dobách vlády komunistické strany v Československu, ale i po Sametové revoluci, kdy uplatňování opačné zásady trvalo ještě mnoho let, než došlo ke zrušení zákona č. 40/1964 Sb. občanského zákoníku. Práce se pak zabývá i znovuzavdením superficiální zásady zákonem č. 89/2012 Sb. občanským zákoníkem, účinným od 1.1.2014. Stěžejní část práce dále blíže analyzuje pojem, funkce, klíčové právní pojmy, detaily... Superficies solo cedit Abstract Thesis deals with the principle of Superficies solo cedit. This old legal principle establishes the legal regime for things located on land. It stipulates that everything connected with the land or growing on it is part of it. The thesis also deals with the historical use of this principle since the days of Roman law, the reception of Austro-Hungarian law after the establishment of the independent Czechoslovak state, through the abandonment of this principle during socialism and communism, to its reintroduction into the legal system of the Czech Republic with effect from 2014. The introductory part of this thesis deals with the historical development of the superficies solo cedit principle, i.e. its anchoring in Roman law, through the Law of the Twelve Tables, Gaius' textbook, the Hermogenian and Gregorian codes, and, of course, the Justinian code. It then discusses its anchoring in the ABGB since 1811. It also analyzes the application of the opposite principle, Superficies solo non cedit, during the rule of the Communist Party in Czechoslovakia, but also after the Velvet Revolution. The application of the opposite principle continued for many years until the repeal of Act No. 40/1964 Coll. of the Civil Code. The thesis then deals with the reintroduction of the superficies...
