70 Úvahy nad rozdíly mezi podmíněným a nepodmíněným trestem odnětí svobody Abstrakt Diplomová práce se zabývá trestem odnětí svobody v českém trestním právu a analyzuje faktory ovlivňující jeho ukládání v praxi okresních soudů. Trest odnětí svobody je v současnosti nejčastěji ukládaným druhem trestu. Při rozhodování o jeho uložení mohou soudci zohlednit celou řadu subjektivních hledisek, která ovlivňují formu i délku uloženého trestu. Je v diskreci soudce, zda bude v konkrétním případě uložen podmíněný trest, což může vést k nerovnostem v rozhodovací praxi. Podmíněný a nepodmíněný trest se přitom svou povahou, průběhem i dopady na odsouzeného zásadně liší. Za účelem zjištění rozsahu těchto nerovností tato diplomová práce předkládá výsledky kvalitativního výzkumu založeného na obsahové analýze rozhovorů se soudci. Polostrukturované rozhovory proběhly v roce 2022 a zúčastnilo se jich 30 soudců okresních soudů. Diplomová práce je rozdělena na teoretickou a praktickou část. Teoretická část se věnuje vymezení trestu odnětí svobody, postavení trestu odnětí svobody v systému trestů a výkonu trestu odnětí svobody. Okrajově se zabývá také alternativními tresty, konkrétně trestem domácího vězení, trestem obecně prospěšných prací, peněžitému trestu, a dále institutem trestního příkazu. Praktická část obsahuje kapitolu... 71 Reflections on the differences between suspended and unconditional prison sentences Abstract This diploma thesis examines suspended and unconditional prison sentences in Czech criminal law and analyzes the factors influencing its imposition in the practice of district courts. Suspended and unconditional prison sentences are currently the most frequently imposed type of punishment. When deciding on their imposition, judges may take into account a wide range of subjective considerations that affect both the form and length of the prison sentence. It is within the judge's discretion to decide whether a suspended sentence will be imposed in a particular case, which may lead to disparities in judicial practice. Suspended and unsuspended prison sentences differ significantly in their nature, execution, and impact on the convicted person. To determine the extent of these disparities, this thesis presents the results of qualitative research based on content analysis of interviews with judges. The semi-structured interviews were conducted in 2022 and involved 30 district court judges. The thesis is divided into two parts: theoretical and practical.
