Trest vyhoštění na dobu neurčitou Abstrakt Tato diplomová práce se věnuje trestu vyhoštění na dobu neurčitou. Jedná se o trest, který se vyznačuje zejména omezeným okruhem pachatelů, kterým je možné trest uložit, neboť jde pouze o dospělé osoby bez státního občanství České republiky. Vedle toho je pro trest vyhoštění na dobu neurčitou příznačná neomezenost jeho trvání a s tím související omezená možnost jeho ukončení. Přestože problematika souvisí i s diskutovaným tématem kriminality cizinců, nebývá jí v České republice věnována přílišná pozornost. Zároveň zahraniční právní úpravy k otázce řešení spáchání trestného činu cizincem jeho nuceným vycestováním ze země zaujímají odlišné přístupy a trest vyhoštění na dobu neurčitou jako součást sankčního systému s nimi z tohoto důvodu nelze jednoduše porovnat. Cílem této práce je poskytnutí uceleného pohledu na trest vyhoštění na dobu neurčitou v současné právní úpravě, a to včetně zjištění, jak se trest v České republice ukládá, a také posouzení, zda lze výkon trestu ukončit a odsouzení zahladit. Práce je systematicky rozdělena do čtyř kapitol. V první kapitole představuje trest v obecné rovině, a proto se zde zabývá zakotvením trestu v právním řádu, jeho historickým vývojem, účelem, ale také vlivem základních zásad trestání či souladem trestu s lidskými právy. V... Sentence of expulsion for an indefinite period Abstract This thesis focuses on the sentence of expulsion for an indefinite period. It is a sentence that is particularly characterized by the limited range of offenders on whom the sentence can be imposed, as it only applies to adults without the citizenship of the Czech Republic. In addition, the sentence of expulsion for an indefinite period is also characterized by its unlimited duration and the consequently limited possibility of its termination. Although the issue is related to the heavily discussed topic of the criminality of foreigners, it is not given much attention in the Czech Republic. Also the foreign legislation takes a different approach to the issue of forcing a foreigner to leave the country on the basis of the commission of a crime, and the indefinite expulsion as part of the sanction system cannot be easily compared with them. This thesis aims to provide a comprehensive view of the sentence of expulsion for an indefinite period in the current legislation, including an examination of how the sentence is imposed in the Czech Republic and whether the sentence can be terminated and the conviction expunged.
