48 Odposlechy a jejich problematické aspekty Abstrakt Cílem této diplomové práce je analyzovat právní rámec odposlechu a záznamu telekomunikačního provozu v České republice a na základě této analýzy identifikovat problematické aspekty, které s jeho využitím v praxi souvisejí. Práce je členěna do pěti kapitol. První kapitoly se věnují obecnému vymezení institutu odposlechu a záznamu telekomunikačního provozu dle § 88 a § 88a trestního řádu v kontextu zásady subsidiarity. Pozornost je věnována rozdílům mezi aktivní a pasivní formou odposlechu a specifickému režimu odposlechu se souhlasem uživatele. Práce se dále věnuje postupu orgánů činných v trestním řízení při realizaci odposlechů. V rámci této části je na základě statistických dat za rok 2024 hodnocena efektivita odposlechů a záznamů telekomunikačního provozu a popsán třístupňový systém kontrolních mechanismů, zahrnující vnější i vnitřní kontrolu. Zvláštní pozornost je věnována nepřípustnosti odposlechu mezi obhájcem a obviněným v souvislosti s judikaturou a ochraně práva na obhajobu. Tématem dalších kapitol jsou procesní aspekty využití pořízeného záznamu jako důkazního prostředku, možnosti jeho použití v jiné trestní věci a postup soudu při provádění a hodnocení těchto důkazů. Další část práce se zabývá problematikou prostorového odposlechu, který v... 49 Wiretapping and Its Problematic Aspects Abstract The aim of this thesis is to analyse the legal framework governing the wiretapping and recording of telecommunication traffic in the Czech Republic and, on the basis of this analysis, to identify problematic aspects associated with its use in practice. The thesis is structured into five chapters. The opening chapters focus on the general definition of the institute of wiretapping and recording of telecommunication traffic pursuant to Sections 88 and 88a of the Code of Criminal Procedure, examined in the context of the principle of subsidiarity. Particular attention is paid to the distinction between active and passive forms of wiretapping and to the specific regime applicable to wiretapping carried out with the consent of the user. The thesis further addresses the procedure followed by law enforcement authorities in the implementation of interceptions. Within this part, the effectiveness of wiretapping and recording of telecommunication traffic is assessed on the basis of statistical data for the year 2024, and a three-tier system of oversight mechanisms is described, encompassing both external and internal control.
