Kontroly studia a rozhodování o právech studentů Abstrakt Diplomová práce je zaměřena na právní aspekty kontrol studia na vysokých školách v České republice a na jejich vztah k rozhodování o právech a povinnostech studentů. Východiskem práce je platná právní úprava obsažená v zákoně č. 111/1998 Sb., o vysokých školách, která je doplněna o poměrně rozsáhlou judikaturu Nejvyššího správního soudu v této oblasti, společně s vnitřními předpisy vysokých škol. V textu práce jsou analyzovány jednotlivé formy kontrol studia uplatňované v praxi na základě vnitřních předpisů vysokých škol, zejména zápočty, zkoušky a státní závěrečné zkoušky, přičemž je zkoumána jejich právní povaha ve vztahu k právům studentů. Současně je detailně popsán platný zákonný proces vedoucí k vydání rozhodnutí o právech a povinnostech studentů, v jehož rámci je pojmenována nejasnost týkající se konečnosti zákonného výčtu těchto rozhodnutí ve smyslu § 68 odst. 1 zákona a dopady tohoto rozporu. Společně s tímto jsou rozebrána i konkrétní typová rozhodnutí uvedená v tomto výčtu, která mají nejužší vazbu vůči kontrolám studia. V rámci analýzy přezkoumatelnosti výše popsaných rozhodnutí o právech a povinnostech studentů a kontrol studia v jejich rámci je přistoupeno k rozboru relevantní judikatury správních soudů, zejména Nejvyššího správního... Monitoring of academic progress and decisions on students' rights Abstract This diploma thesis focuses on the legal aspects of the monitoring of academic progress at higher education institutions in the Czech Republic and their relationship to decisions on students' rights and obligations. The thesis is based on the applicable legal framework contained in Act No. 111/1998 Coll., on Higher Education Institutions, supplemented by a relatively extensive body of case law of the Supreme Administrative Court in this field, together with the internal regulations of higher education institutions. The thesis analyses individual forms of the monitoring of academic progress applied in practice on the basis of internal regulations of higher education institutions, in particular, course credits, examinations, and final state examinations, and examines their legal nature in relation to students' rights. At the same time, the current statutory procedure leading to the issuance of decisions on students' rights and obligations is described in detail, within which ambiguity concerning the exhaustiveness of the statutory list of such decisions pursuant to Section 68(1) of the Act and the consequences of this inconsistency are identified.
