Právo obětí sexuálních trestných činů na ochranu před druhotnou újmou v přípravném řízení trestním a jeho uplatňování v praxi Abstrakt Diplomová práce se věnuje aplikační praxi orgánů činných v trestním řízení v oblasti ochrany obětí sexuálních trestných činů před druhotnou újmou v přípravném řízení trestním. Konkrétně se zabývá zjištěním, jaká praxe v této oblasti je a zda odpovídá viktimologickým standardům. V teoretické části diplomové práce zasazuji jednotlivé pojmy užívané v diplomové práci do celkového kontextu této práce. Současně definuji, jaké požadavky jsou kladeny na orgány činné v trestním řízení z hlediska viktimologických doporučení k jednání s obětmi sexuálních trestných činů. Tyto požadavky představují kritérium pro vyhodnocení aplikační praxe a jejích nedostatků. V teoretické části práce se zabývám i právním rámcem ochrany obětí sexuálních trestných činů se zaměřením na ochranu obětí před sekundární viktimizací. Právní rámec ochrany obětí představuje východisko pro aplikační praxi orgánů činných v trestním řízení. Teoretickou část ve čtvrté kapitole doplňuji o inspiraci ze zahraničí v oblasti ochrany obětí sexuálních trestných činů. V empirické části jsem pomocí metod polostrukturovaných rozhovorů, pozorování a analýzy dokumentů provedla kvalitativní výzkum. Prostřednicím výzkumu jsem... The right of victims of sexual offenses to protection against secondary harm in pre-trial proceedings and its application in practice Abstract This thesis focuses on the practical application of law enforcement agencies in the area of protecting victims of sexual offenses from secondary harm in pre-trials proceedings. It examines the current practice in this area and whether it complies with victimology standards. In the theoretical part of the thesis, I situate the individual terms used in the thesis into the overall context of this work. At the same time, I define the requirements placed on law enforcement agencies in terms of victimological recommendations for dealing with victims of sexual offenses. These requirements represent the criteria for evaluating application practices and their shortcomings. In the theoretical part of the thesis, I also deal with the legal framework for the protection of victims of sexual offenses, with a focus on protecting victims from secondary victimization. The legal framework for victim protection provides a basis for the application practice of law enforcement authorities. Chapter four complements the theoretical part with inspiration from foreign jurisdictions in the field of protection of victims of sexual offenses. In the empirical part, I conducted qualitative...
