Alternativní tresty a jejich vliv na resocializaci odsouzeného Abstrakt Tato rigorózní práce se primárně zabývá problematikou alternativních trestů, přičemž největší pozornost je věnována peněžitému trestu, trestu obecně prospěšných prací, trestu domácího vězení a podmíněnému odsouzení k trestu odnětí svobody. Úvodní část práce se zaměřuje na obecné otázky spojené s alternativními tresty, zejména na jejich účel, důvody, výhody, systematizaci a kategorizaci. Již v první kapitole jsou uvedeny praktické a reálné statistické údaje, z nichž je možné zjistit například míru zaměstnanosti odsouzených v českých věznicích, průměrné náklady státu na jednoho odsouzeného, procentuální zastoupení alternativních trestů v soudní praxi či počet odklonů s restorativními prvky v přípravném řízení v letech 2011-2023. Pozornost je věnována rovněž historickému vývoji alternativního trestání, který je stručně a přehledně popsán od období feudalismu, přes éru stavovského a absolutistického státu, až po moderní dějiny a polistopadové změny po roce 1989. Třetí kapitola se soustředí na podstatu, principy a přínosy restorativní justice, která namísto represivního přístupu a potrestání pachatele klade důraz na jeho reintegraci a resocializaci. Uveden je také známý případ Elmira Case, jenž se uskutečnil v roce 1974 v kanadské provincii... Alternative punishments and their impact on the resocialization of the convicted person Summary This rigorous thesis primarily deals with the issue of alternative punishments, with particular attention devoted to monetary penalties, community service, home confinement, and conditional sentences of imprisonment. The introductory part of the thesis focuses on general questions related to alternative punishments, especially their purpose, rationale, advantages, systematization, and categorization. The first chapter already presents practical and factual statistical data, from which it is possible to determine, for example, the employment rate of convicted persons in Czech prisons, the average state expenditure per inmate, the percentage share of alternative punishments in judicial practice, or the number of diversions incorporating restorative elements in pre-trial proceedings between 2011 and 2023. Attention is also given to the historical development of alternative punishments, which is concisely and clearly described from the period of feudalism, through the era of the estate- based and absolutist state, up to modern history and the post-1989 transformations.
