Eutanazie v kontextu trestního práva Abstrakt Tato diplomová práce se zabývá fenoménem eutanazie a pojmů s ní souvisejících v kontextu trestního práva. Jedná se o celospolečensky dlouhodobě diskutovanou problematiku, jejíž důležitost se zejména v posledních několika letech opět dostává do popředí zájmu nejen odborné veřejnosti. Práce si klade za cíl rozebrat problematiku eutanazie v souvislosti s trestnými činy, které svou skutkovou podstatou naplňují některý ze způsobů provedení eutanazie, či asistované sebevraždy. Zvláštní důraz práce klade na české právní prostředí a stav eutanazie v České republice. Práce samotná je rozdělena do čtyř kapitol. První kapitola práce je zaměřena na eutanazii jako takovou, je zde představeno základní rozdělení a pojmy s ní související, jako například asistovaná sebevražda, revers, či dříve vyslovené přání. Jádro diplomové práce představuje druhá kapitola, která se podrobně zabývá eutanazií v kontextu trestního práva. Postupně jsou představeny trestné činy vraždy, zabití, účasti na sebevraždě a neposkytnutí pomoci, přičemž u jednotlivých trestných činů je vždy podrobně rozebrána jejich souvislost s eutanazií, za jakých podmínek dochází k naplnění skutkových podstat a zejména tato kapitola poukazuje na některé nedostatky české trestněprávní úpravy. Třetí kapitola práce je... 1 Euthanasia in the context of criminal law Abstract This thesis deals with the phenomenon of euthanasia and related concepts in the context of criminal law. It is a long-debated issue in society, the importance of which has come to the forefront of interest not only among experts in recent years. The thesis aims to analyze the issue of euthanasia in connection with criminal offenses that, by their nature, fulfill one of the methods of euthanasia or assisted suicide. The thesis places particular emphasis on the Czech legal environment and the status of euthanasia in the Czech Republic. The thesis itself is divided into four chapters. The first chapter focuses on euthanasia as such, introducing the basic classification and related concepts, such as assisted suicide, advance directives, and prior expressed wishes. The core of the thesis is the second chapter, which deals in detail with euthanasia in the context of criminal law. It gradually introduces the crimes of murder, manslaughter, participation in suicide, and failure to provide first aid, with each crime being analyzed in detail in relation to euthanasia, the conditions under which the elements of the crime are fulfilled, and, in particular, this chapter points out some shortcomings in the Czech criminal law.
