Kumulace podmíněných trestů Abstrakt Diplomová práce se zabývá tématem kumulace podmíněných trestů, tedy situací, kdy dochází k souběžnému ukládání a výkonu více trestů odnětí svobody s podmíněným odkladem jedné osobě. Téma reaguje na aktuální problémy aplikační praxe, kde se navzdory teoretickému zakotvení podmíněného trestu jako formy výkonu trestu odnětí svobody přistupuje k tomuto institutu spíše jako k samostatnému druhu trestu. Tato praxe vede k situacím, kdy jsou pachatelům opakovaně ukládány podmíněné tresty, přestože ve zkušební době předchozího odsouzení spáchali další trestný čin, což ve svém důsledku často končí řetězením přeměn trestů a následným dlouhým uvězněním. Cílem práce je lépe porozumět důvodům, které k ukládání kumulovaných podmíněných trestů vedou, zmapovat četnost tohoto jevu a identifikovat faktory, které jej ovlivňují. Teoretická část práce vymezuje institut podmíněného trestu a upozorňuje na rozpor mezi jeho zákonnou konstrukcí a praktickým vnímáním, kdy je často chápán jako "druhá šance" či pouze formální hrozba. Práce analyzuje nedostatky současné právní úpravy, která podrobně neřeší postup při ukládání trestu pachateli, jenž má již uložen dosud nevykonaný trest. Těžištěm diplomové práce je empirický výzkum realizovaný na vybraném obvodním státním zastupitelství v Praze. Autorka... Cumulative suspended sentences Abstract This thesis examines the issue of cumulative suspended sentences, i.e., situations where multiple prison sentences are imposed and served concurrently with a suspended sentence on one person. The topic responds to current problems in application practice, where, despite the theoretical basis of a suspended sentence as a form of imprisonment, this institution is treated more as a separate type of punishment. This practice leads to situations where offenders are repeatedly given suspended sentences even though they have committed another crime during the probation period of their previous conviction, which often results in a chain of sentence conversions and subsequent long imprisonment. The aim of this thesis is to better understand the reasons that lead to the imposition of cumulative suspended sentences, to map the frequency of this phenomenon, and to identify the factors that influence it. The theoretical part of the thesis defines the institution of suspended sentences and points out the contradiction between its legal construction and practical perception, where it is often understood as a "second chance" or merely a formal threat.
