61 Pachová identifikace - problémy současné praxe Abstrakt Diplomová práce se zabývá metodou pachové identifikace osob z pohledu kriminalistiky i trestního práva. Popisuje podstatu kriminalistické odorologie, vznik a zajištění pachových stop a metodu pachové identifikace osob za využití speciálně vycvičených služebních psů a metody pachových konzerv. Práce se zaměřuje také na analýzu spolehlivosti metody pachové identifikace a zkoumá její právní zakotvení v českém právním řádu, včetně jejího zařazení v systému důkazních prostředků. Práce vychází z podrobného rozboru odborných publikací, platné legislativy a rozsáhlé judikatury, přičemž se zabývá mimo jiné i známým případem vraždy ve Slopném. Na základě studia těchto zdrojů práce přibližuje vývoj a současný stav využívání pachových stop v kriminalistické praxi a analyzuje, jak jsou výsledky této metody hodnoceny orgány činnými v trestním řízení. Diplomová práce poukazuje na kontroverze provázející danou metodu a na rozdíly v názorech na její průkaznost, jak vyplynuly ze zmíněného případu i z dalších soudních rozhodnutí. Závěrečná část práce se zaměřuje na aktuální právní úpravu zajišťování a využití pachových stop v České republice a detailně rozebírá nejnovější soudní rozhodnutí vztahující se k této problematice. V rámci hodnocení metody pachové... 62 Scent Identification - Challenges of Current Practice Abstract This diploma thesis deals with the method of scent identification of persons from forensic and legal perspectives. It describes the essence of forensic odorology, the origin and collection of scent traces, and the procedures for scent identification using specially trained dogs and scent evidence preserved in so-called "scent canisters." The thesis therefore also focuses on analyzing the reliability of this method and examines its legal anchoring in Czech law, including the role of scent identification within the system of evidence in criminal proceedings. The work is based on a detailed analysis of professional literature, applicable legislation, and extensive case law, including the well-known Slopné murder case. Using these sources, the thesis outlines the development and current state of the use of scent traces in forensic practice and analyzes how the results of scent identification tests are evaluated by law enforcement authorities and courts. The thesis highlights the controversies surrounding this method and the differences in opinions on its probative value, as evidenced by the aforementioned case and other court decisions.
