1 Alternativní metoda právní regulace a její vnímání adresáty práva Abstrakt Tato diplomová práce se věnuje Alternativní metodě právní regulace jako jedné z metod regulace chování ve společnosti. Práce je rozdělena na dvě části, část teoretickou a praktickou. Cílem teoretické části práce je vymezení alternativní metody právní regulace. Tato metoda je postupně vymezena jednak s ohledem na její teoretické zasazení do kontextu právního normativismu a sociologického přístupu k právu, ale také z hlediska jejích charakteristických znaků, jakými jsou, možnost volby typu regulace adresátem, mezi regulací právní a neprávní, dopad této volby na postavení adresáta a dvoukolejnost úpravy regulované činnosti, která touto volbou vzniká. Jako modelový příklad byla pro toto vymezení i zbytek práce zvolena regulace mediace v českém právním prostředí, neboť právě mediace je regulovaná za použití alternativní metody právní regulace. Praktická část práce se zabývá výzkumem vnímání alternativní metody právní regulace jejími adresáty. K výzkumu byla zvolena kvantitativní metoda a v jeho rámci bylo provedeno dotazníkové šetření na výzkumném vzorku 35 mediátorů aktivně působících v České republice. Mezi hlavní výzkumné otázky patřila otázka, z jakého důvodu se mediátoři rozhodli stát mediátory zapsanými či nezapsanými, mapující... The Alternative Method of Legal Regulation and its Perception by their Addressees Abstract This thesis deals with the Alternative Method of Legal Regulations as one of the methods that can be used to regulate one's behaviour in society. The thesis is divided into two parts, a theoretical one and a practical one. The aim of the theoretical part is to introduce and define the alternative method of legal regulation. This method is defined with regard to the theoretical context of legal normativism and the sociology of law as well as with regard to its characteristic features. These defining features are the option of the addressees to choose between legal and nonlegal regulation, the limited impact of such choice regarding their legal status and lastly the dual-track system of such regulation that emerges as a result of this choice. The regulation of mediation in the Czech legal system has been selected to serve as an example of the use of the alternative method of legal regulation for the purposes of this thesis. The practical part of this thesis is concerned with research of the perception of the alternative method of legal regulation by its addressees.
