Pracovníci digitálních platforem: Analýza jejich postavení a dopadu nové evropské směrnice Abstrakt Tato diplomová práce se zabývá posouzením právního postavení osob vykonávajících práci prostřednictvím digitálních pracovních platforem se zaměřením zejména na oblast přepravy osob a rozvozu zboží. Cílem práce je zhodnotit, zda jsou pracovníci digitálních platforem skutečně nezávislými podnikateli, jak je často označují digitální platformy, či zda se jedná o zastřený výkon závislé práce mimo základní pracovněprávní vztah. Za tímto účelem jsou pak v diplomové práci nejdříve vymezeny klíčové pojmy související s výkonem práce prostřednictvím digitálních platforem a je popsán aktuální právní rámec úpravy jak závislé práce, tak podnikání fyzických osob a problematika švarcsystému. Stěžejní část práce tvoří komparativní analýza dvou významných platforem působících v České republice, a to platformy Uber poskytující přepravu osob a online supermarket Rohlik.cz zajišťující rozvoz potravin koncovým zákazníkům. V prvním z uvedených případů je posuzováno postavení řidičů vůči platformě Uber, a to jak z hlediska smluvního vymezení vztahu, tak z hlediska faktického postavení řidičů dle platné právní úpravy se zohledněním relevantní judikatury českých a zahraničních soudů. Digital Platform Workers: Analysis of Their Status and the Impact of the New EU Directive Abstract This thesis deals with the assessment of the legal status of individuals performing work through digital labour platforms, with a particular focus on the fields of passenger transport and goods delivery. The aim of the thesis is to evaluate whether platform workers are genuinely independent entrepreneurs, as they are often referred to by digital platforms, or whether this is a disguised performance of dependent work outside the basic employment relationship. For this purpose, the thesis first defines key terms related to the performance of work through digital platforms and describes the current legal framework governing both dependent work and the self-employment of natural persons, as well as the issue of false self-employment. The core part of the thesis consists of a comparative analysis of two significant platforms operating in the Czech Republic - the Uber platform providing passenger transport and the online supermarket Rohlik.cz ensuring grocery delivery to end customers.
