[cze][eng] Právní rámec použití odposlechů a obdobných prostředků v České republice Abstrakt Tématem předkládané diplomové práce je právní rámec použití odposlechů a obdobných prostředků v České republice. Cílem práce je uceleně představit a zhodnotit současnou tuzemskou právní úpravu odposlechů a dalších prostředků tajného sledování, a to optikou ústavněprávních požadavků kladených na výkon veřejné moci v demokratickém právním státě při zajišťování bezpečnosti. Po obecném vymezení prostředků tajného sledování a objasnění důvodů pro odlišení trestněprocesního a zpravodajského režimu jejich použití je celá problematika zasazena do širšího kontextu. Vedle kořenů práva na soukromí je upozorněno i na kontinentální státoprávní tradici policejního státu, jehož odkaz dodnes formuje vnímání sledování ze strany státu. Reflektovány jsou také zkušenosti s totalitními režimy, které se promítly do znění mezinárodních smluv i vnitrostátní úpravy. Na tomto základě jsou analyzovány současné mezinárodní závazky České republiky a podrobně zkoumána judikatura Evropského soudu pro lidská práva, která pro zásahy do soukromí stanoví přísná kritéria. Zvláštní pozornost je věnována dynamicky se vyvíjející judikatuře Soudního dvora EU k plošnému uchovávání dat, na kterou český zákonodárce dosud adekvátně nereagoval. Abstract The thesis examines the legal framework governing the use of interception and recording of telecommunications traffic and similar covert surveillance measures in the Czech Republic. The aim of the thesis is to provide a comprehensive account and evaluation of the existing domestic regulation through the lens of constitutional guarantees applicable to the exercise of public authority in a democratic state under the rule of law for the purposes of security. Following a general definition of measures of covert surveillance and clarification of the grounds for differentiation between the criminal procedure framework and the framework of intelligence services for their use, the entire subject is placed in a broader context. In addition to the roots of the right to privacy, consideration is given to the continental state law tradition of the police state, whose legacy continues to shape the perception of state surveillance to this day. Experiences with totalitarian regimes, which have been reflected in the formulation of international treaties and domestic regulation, are also examined.
